Hi there everyone... just have a question. First a background of my case. I-129F filer, waiting for NOA2. December filer here.

My question is about the criminal records that might be asked by CO or by the adjudicator. My fiance was divorced many years ago. His ex wife filed a case against him for domestic violence/ physical assault or something like. He was jailed one night and went out thru bail as per my fiance. But knowing my fiance he cant do that. Anyways... when we filed the K1 petition we would like to add the criminal records and my fiance tried to get it but the police said the record could no longer be found. Is there a way we could get something from the police like a statement that the record/s is no longer there? And is there a chance that the background check USCIS is doing could still the case filed against my fiance?

That is not a criminal record. That is arrest for arraignment. When no charges are filed or charges are dismissed or not found guilty, you have no conviction, you are not a criminal. IS that the case? Hence no records of criminal file, except arrest. You may not need to disclose arrest unless they specifically ask,,, hv u been arrested. But if the case is dismissed or never filed, your arrest is now a detention. Get attorney to request detention letter from police dept.
