N-400 based on 3 year rule

Hi All,

Its been a while since I posted here (2013 when AOS was submitted for my wife and daughter,) so my wife and I are getting ready to submit her N-400 package on 2/8/2016. We are coming up on 6 years of marriage (Feb 2016) and 3 years of her being an LPR (05/08/2016.) We have two biological children together and our oldest daughter (my step daughter, but I consider her mine.) We are putting together the package and I know that the directions say to include: Marriage Certificate, My Birth Certificate, Tax Return Transcripts, etc. I am wondering if the following will be enough documentation to prove a bona fide marriage based on the 3 year rule?

This is what we have on the cover letter so far.

Dear Sir/ Madam:

Please kindly find enclosed my N-400 Application for Naturalization and supporting documents. I am eligible for Naturalization based on being married for at least three years to my US citizen husband.

Contents include:

N-400 Application for Naturalization

• Form N-400 Application for Naturalization

• One supplemental information page (Page 7, Part 8, Question 3: Time Outside the U.S.)

• Form G-1145 E-Notification of application/petition acceptance

• Form G-1450 Authorization for Credit Card Transactions (payment of N-400 and biometrics fee $680.00)

• Copy of both sides of Permanent Resident Card

• Two (2) Identical Color Photos with full name and A# on back and name on plastic bag

• Copy of my birth certificate with English translation

• Copy of my husband’s US birth certificate

• Copy of marriage certificate

• Copy of IRS Tax Transcripts for years 2012, 2013 and 2014 filed jointly by my husband and I

• Copy of FS-240 Consular Report of Birth Abroad for one of our daughters born 4/8/2010

• Copy of US birth certificate for our youngest daughter born 2/26/2015

• Copies of Home Mortgage statements for my current residence, addressed to my husband and I (Included are mortgage statements for 10/08/2015, 11/02/2015, 12/02/2015, 01/02/2016 and 02/02/2016)

Should we include more documents such as: the Grant Deed for the recent purchase of our home, car and home insurance, gas bills and bank statements, all which have both of our names on them? We don't have the cars in both of our names, because I bought my car before marrying her and her recent car we bought in September of 2014, but she didn't update her social security number to state that she was an LPR as she had gotten it while she had her EAD which caused her to not have credit and the stealership (those blood suckers) didn't want to add her to the title because of no credit.

For some reason, my lawyer is asking me to file only with copy of my green card, application fee and passport photos.

Can someone comment?

That is all that is required if you are applying based on 5 years of residence (not on marriage to a US citizen).

Go to the N400 application page on the USCIS website.

Click on the document checklist lick.

Send in everything that's listed there that applies to your case.

Hi,

I am in a very similar position to you right now. We are gathering documents to send and we were wondering whether to send in the entire IRS Tax transcripts or just a summary sheet?

Also, as you're apply with marriage entitlement, which option did you choose on the part of the N-400 where you have to list trips overseas and places of residence for the past 5 years? Did you choose to just list the past 3 years (time since marriage) or did you also include anything in the additional 2 years prior to marriage?

For the AOS I sent in the full amount of pages in the IRS Tax Return Transcripts. For the trips I began using a phone app that allowed me to track the trips since my wife became an LPR. We used to live outside of the US before then on a border town so we were crossing weekly thus we never kept track, plus I read some where in the instructions that if you're doing the 3 year entitlement to only include since you became a legal resident.

So anyone out there that has file on the 3 year rule, what documents did you send to prove bonafide marriage?

Sorry forgot to add that since we had sent in all pages of the IRS transcripts for AOS, we're doing the same on the N-400. That way if USCIS needs it, they have it.

Hello. I submitted my N400 form in December 2015, going for biometrics next week. I included copies of our children's birth certificates, apartment lease documents under both of our names, 2014 taxes (only 1st page with all of our names). They didn't ask about extra documents before scheduling an appointment. But it's too early to tell. For my interview I want to bring a couple of different utility bills, probably all of our tax transcripts, car insurance under our names.. I guess I will print out some family pictures (newborn session with kids, meeting with my parents in my home country and in US just to verify that my parents and my husband know each other). Nothing else comes to mind right now.

All that is good, but you should add more evidence that you are living with your spouse as one of the central requirements to file under the 3-year rule is cohabitation with your USA citizen spouse for all three years

 

So, include:

Copies of both of your state ID with common address

W2/1099 forms for each year during last 3 years plus from both of you -- should have your common home address --

Joint mortgage statements during year

Property Tax bills in both names

Copy of deed for your home (Should in closing docs)

Monthly statement from joint bank accounts with deposit/joint bills paid

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
