Howdy from Texas!

I'm an immigrant myself coming from the Philippines 10 years ago, becoming a US naturalized citizen 5 years ago.

After reading through the forums and the different US sites, I'm still not sure of what route to take.

Story:

I met a girl who was here as an aupair... Actually, I have a lot of aupair friends...

Either way, she was done with her year and left the US. I visited her and Germany because I haven't been to Europe.

She's coming back to the US using the VWP to see if we're compatible; we haven't lived with each other. We have been friends for more than 6 months; see each other 2-3 times a week because we country dance together.

At this point, there are no plans of getting married. Not even an engagement ring because we both believe in doing things the right way, and spending time together is part of that.

But, because I'm somewhat of a planner, I'm doing the research now to see what the possibilities might be IF we are actually "for each other."

So, with your knowledge and or experience, what do you think of the situation?

Possibilities:

Best - We get married after 2 months, she somehow is able to stay here.

Worst - We get married after 2 months, she can't stay.

How did it go from "there are no plans of getting married" to "We get married after 2 months"?

I'm not sure whether you are asking about "what do we think" from a relationship point of view or immigration law point of view. From an immigration point of view, she should not enter on VWP with preconceived intention to stay in the US (regardless of whether there is intention to get married or not). However, if she is in the US and gets married to you and and changes her mind and decides to stay without leaving the US, she is eligible for Adjustment of Status, legally speaking.

****** This is way too close to advising on illegal immigration, as the OP's girlfriend is outside of the country and it is visa fraud to use the VWP program or a tourist visa to enter the USA with the intent of getting married and staying. This thread is now closed. *****
