Case Status online this morning said my case was approved, no email on it yet though. You should hear back super soon I hope!

That is excellent news, congratulations!!!

We had no luck, still no response. We check up to three times per day. Going crazy waiting.

So I finally got my denial letter from the USCIS and the reason for the denial was, "based on the evidence you have submitted you have failed to establish your civil marriage with MY WIFE NAME took place prior to the date of filing the Form I-130. Therefore, the petition is denied.

In pretty short terms I petition for my wife before I was married through civil marriage, and when I petition we only got married through church but not knowing that was not valid according to the USCIS. Even though I had ask and inquired in at my local USCIS office and they mention to me that any wedding would have been enough for a spousal petition.

Now I don't know if I should appeal and explain the reasons why we never did a civil wedding and later we did, or drop the case and start all over and wait another 6 months to see whats going to happen. This is really sad that personnel that work for this departments are not fully aware of their own guidelines and mislead people in this case me. Has anyone encounter something similar to my case. If there's anyone that can help me with please do so, or even your suggestions would help.

Another things was can my wife request for a tourist visa to come and visit me.

To all of you who had your case approved congratulations!!! you are just few steps from being together with your spouses.. :dancing::dancing:

If i were in ypur situation I would start the process all over again and if you have the time and money then work on the appeal.However it is my opinion that it is very unlikely that they will rescind their decision. In regards to the tourist visa I would also recomend against it. They will evaluate her based on the intention to migrate, wich is the opposite of a tourist visa and.deny it. Just my humble opinion and good luck. Please continue to share with all of.us your experience.

01/25/16 Nebraska and still no second notice. Unable to file a case inquiry. It states it is still within the allowed time. We are desperate... Any comments are appreciated.

We are 12/23/15 Nebraska. One month ago I asked for a "Tier 1" inquiry for outside the processing time. I was told that the application more or less had been forgotten but they would start it up again. I just asked for another ping. you have to wait 30 days between the tier 1 requests

So we are in the same boat. Unfortunately my wife lives too far away otherwise, if she were Honduran or something she could come right away by the land route.(kidding but almost serious)

Thanks for thw info, how did you request the inquiry? Every time i try to do it via the. Website it says to allow more time that is still under the normal processing time. Thanks in advance.

I called to inquire on case and they stated that for Nebraska they were still processing 01/02/16. Does this sound right? They indicated that there was nothing that could be done. We are so impatient at this point.

Its so easy to get discourage.

But hopelly soon.

Received text this evening of RFE. Hope it's nothing out of the ordinary. NOA1 - Jan 7

Great at least you got some news and hopefully is something easy to resolve.

This is after being told last week that they were on jan 7 last week. I am jan 25. Any tips or advice on the next step? Good luck to everyone.

CONGRATS! That first long wait should be our hardest. I think the next step is our DS-260 form online but we have to wait for NVC. Whoever will be submitting tax information should get that all prepared now, it can be requested from the government. I have not requested mine yet though.
