Today I got a RFE they want additional info regarding my traditional marriage and divorce decree.

I'm a little bit confused, before I had submitted all my paperwork for the petition for my wife. I had inquired and called the USCIS regarding what was considered a legal marriage. They told me that as long it was a marriage civil or traditional it would be considered a marriage. Now in the letter that I have received they want evidence of a civil marriage that never took place. My wife wanted a traditional wedding in Mexico so we got married without having a civil ceremony and our plans was that as soon that she got her visa that we were going to get married here in the US.

2nd question regarding my divorce decree, I got divorce in California and whoever lives here in this state knows that the court will send you a the final judgement that says that your marriage should be terminated by certain date. I submitted that from the beginning but know they want more evidence which I don't know what else to send?

The letter says NOTE: A Divorce Nisi is note considered to be evidence of a final divorce.

Can someone please help me and guide and tell which is the forms that I must submit for evidence for my divorce decree? I have all the paperwork from my divorce from when I filed in the court.

Now going back to my actual marriage I do have a Marriage Certificate from the church we got married and also submitted that at the beginning with all my package.

Now if the USCIS thinks that my marriage is not valid because we never got married through civil it is possible to change the case to a K-1 visa instead of a CR-1?

I would really appreciate all your help, it's been a long 5 months journey me and my wife have been waiting for our NOA2 but now this RFE came in

I want to do everything as soon as possible to continue the process, but also I want make sure I do it right, so they won't deny our case.

In advance thank you for all your help....

I can't speak to the issue regarding traditional vs civil marriage. Regarding your divorce, I was also divorced in California. I sent in as evidence the final "judgment" papers I got from the court that says the marriage was terminated on [this date]. I never received any other papers; I'm not sure "divorce nisi" is something that is issued in California. Are you sure you sent the final judgment? You mention the paper you sent said the marriage "should be terminated" on [this date] which doesn't sound final.

Hello Gretch,

I submitted the notice of entry of judgement and there's a box that stipulates that effective date of termination of marital or domestic partnership status (date)

Yes, that's exactly what I sent in (and got approved), then. Maybe you can download some California divorce law stuff and send it in with a note of explanation? I think I did send in not just the judgment, but several of the other pages from the divorce court.
