Well sorry to hear. There's nothing you can do about the process. He has a 1 year Ban can't change that. You could decide to have the child in Jamaica so he is there. But otherwise it will be a year. Where he will be tested and has to go to counseling than he can have his interview in a years time. Sorry.

Actually, even if the USC is the man he has to meet the physical presence transmission requirements:

A U.S. citizen parent may transmit citizenship if s/he has been physically present in the United States for a certain amount of time prior to the childs birth. For children born on or after November 14, 1986, the citizen parent must prove that s/he was physically present in the U.S. for 5 years, 2 of which were after age 14. It is important to recognize that the burden of proof is on the applicant. Physical presence may be proven by presenting a combination of records such as school transcripts, social security statements, old and current passports, etc., to show that the physical presence requirement has been met.

If the mother is not married:

An unmarried U.S. citizen mother may transmit citizenship to a child born abroad if she has been physically present in the United States for a certain amount of time prior to the childs birth. For children born on or after November 14, 1986, the mother must prove that she was physically present in the U.S. for a minimum period of one continuous year. It is important to recognize that the burden of proof is on the applicant. Physical presence may be proven by presenting a combination of records such as school transcripts, old and current passports, vaccination records, etc., to show that the physical presence requirement has been met.

Directly caal an immigration lawyer and see if u can fight this on! You might ask the consulate to do a urine test. To test for drugs, this might work, also mention that u are pregnant and gat labor in 3 months.... hope this works no garanty but its worth the try. An immi lawyer costs money but information is free. Never shot is a missed shot. Good luck! And i feel sorry for u 2

My husband visa denied because he admitt that he use drugs in the pass(smoke weed)however they gave him one year before he can do his medical again,but I am currently 6 month pregnant,he was suppose to be here for the birth of his child.what can I do?

April 17 2015 send I-130

April 22 2015 recieved I-130 vermont

april 28 2015 noa 1 in the mail

September 21 2015 transffered from vermont to california

October 05 2015 I-130 approved at california

october 09 2015 noa 2 in the mail

October 21 2015 case recieved at nvc

December 9 2015 all mail at nvc

can someone please elaborate on the situation:

my wife's interview passed very smooth but at the end the CO says to collect passport after one month and she has not been given any 221G.

her status changes to administrative Process soon after her interview.

Based on your country which is Pakistan there is mandatory Adminisrtative processing you cannot do anything there at best you can hope it finish quickly but there is no guarantee that it will happen....so you will have to wait in most cases it gets over within 15 days or less and since interview was smooth and everything was ok I would say just wait for 2 weeks and it will change to issued.....sorry there isn't much info what happen in AP but looks like all cases for certain embassy goes to AP and yours is one of them.... I hope she gets visa soon...

Our interview was on Jan21. All went well until the CO asked for the original divorce cert of the Petitioner. In the P4 it was not mentioned that the orignal was needed as we have enlcosed a certified copy when we file I-130. Anyway we are now in AP :( pending the submission of the original documents.

Interview question asked -

1) Where did you meet?
2) In your own words, how did you both get acquainted?
3) I see he was previously married, are you not concern? And the big age gap? (we have a 12 years gap)
4) In your own words, how do you know he is the one and why you decided to marry him?
5) Do you remember his previous divorce date?
6) Why did he just apply for a divorce when he was separated with his ex-wife for so long?
7) How old are his kids now?
8) Have you ever been to US?
9) Where would you be staying when in the US?
10) How long have you stayed in the US?
11) Have you stayed in another country before this?

Is this the same for people who come here to have babies and then go back to their country? I mean you have tgo have lived here a certain amount of time before 18 years old right to be considered a TRUE US citizen. Or am I wrong?

Yes all originals have to be presented at interview. Something presented at USCIS by petitioner will not be on a NVC checklist.

Unfortunately have seen many people put in AP asking for petitioners original or certified copy. These things are not forwarded. USCIS keeps all copies of everything. Notice how you have to resubmit marriage certificates

Saying all that i say this EVERYBODY who has been divorced petition and Beneficiary Please have your original/certified copy for your interview.

Better to have and not need, then need and not have.

Really sorry for your delay. But it will go fast I hope it won;t take much to get the copy.

Sure try a consult with a lawyer. But there is nothing you can do about an admitted drug usage. It's a 1 year ban doesn't get overturned no matter how hard you try. Jamaica is notorious for this ban. Scrutiny is very high and you can go have as many other drug test you want. Obviously only from the immigration doctors will it count.

Sorry OP for your turn of events. Just tell your husband to adhere to the regulations of counseling and random testing for the next year.

I don't think so, if you are born in the US then you are a full citizen, actually that's my case :) my parents lived in the States for two years before I was born (both Argentineans) a month after they came back to Argentina bringing me obviusly buy I'm a USC, that's why I know about crba (i now have two daughters of my own that are not USC because I don't meet the requirements.
