I-751 application Dec

Hi Guys,

Happy New Year and holiday!!! I have a couple of questions want to ask and need your advice.

1, I filed my I-751 on Dec 28th, because we have so many paper work, bank statements, utilities bills, thats why I stapled every bank statements, utility bills by month (I thought it's easier for them to check month by month) we have over 50 months combined, which means there have over 50 staples they need to take out, i am so sorry.. After I mailed all the stuff, I just realized that they prefer us to use paper clip or ACCO fasteners... I want to know anyone here ever used heavy staples and been through just fine? or they will reject my application because I use staples? I am so sorry!! I would definitely use paper clip or ACCO fasteners if let me do it again! Thank you!!!

2, I filed my i-751 on Dec 28th with certified mail and return receipt, checked USPS, it was delivered on Dec 30th, I understand it is holiday season right now, i just check my bank, they have not cashed my check yet, i want to know usually when we can receive the receipt or they cash our check after they receive the packet?

1. It will not be rejected because of staples.

2. You need to be patient. Usually the check is cashed within 2 weeks but it can take up to a month, just like with your AOS. Checking your account the day after delivery is unreasonable.

Well here's a good a place as any to resume our trek on the forum. After the disgustingly long and arduous process to the conditional GC, it was nice to take a rest. But the rest is over. Our lawyer submitted our rather thick and heavy I-751 package on 12/28. So it begins again. Not looking forward to it. Looks like we dodged the new form (though after how many billions of dollars trying to digitize forms, this new one still is not - but hey we're talkin' 'bout USCIS here).

I don't expect this to be much easier than before, but maybe they'll surprise me...Yeah right!!

I was wondering if any of you received two almost identical receipt notices for your recently filed I-751 packets? I filed mine in mid-December and got two receipt notices with two different receipt times and receipt numbers...

No receipt yet, but the timelines show I-797 NOA's in about a week, before Christmas. Who knows how the holidays will back things up. It is USCIS, well noted procrastinators...

I mailed our package on 12-23-15 and confirmed that they received it on 12-24-15 and the check was cleared through my bank on 12-29-15 so it took 3 business days! I guess they needed the $$$$$.

I am confused by your timeline (which I follow since my husband and I have a quite similar one).

Aren't we supposed to apply for ROC 2 years from the expiration date of our "conditional" residency as per USCIS guidelines?

If so, you would not be entitled to apply until 90 days before your green card was approved (4/18/15).

Could anyone reading this thread shed some light on the matter?

My understanding is that the marriage anniversary doesn't have much to do with the ROC, and that the 2-year anniversary is related to when one received the green card.

Any thoughts?

Hi Nikkosan. Hope you guys are well. You are correct, you must apply for ROC within the 90 day window of the expiration of your conditional card. So you ask, why are we applying now. Well this has to do with IO discretion. The day we were approved for my wife's GC, we were called by the IO handling our case because she needed our marriage certificate. We agreed to fax it immediatlely (we did and were approved in 4 hours). However the IO officer spent an additional 10 minutes explaining what was required for ROC, "...in a year...", and she emphasized this. We just thought it in error. But 3 days later we got a transmittal note with hand written dates of the GC date and expiration dates. These were a year earlier (both issue date and expiration date). Again we thought it to be in error. Our lawyer said the IO's have discretion as to 10 yr cards and conditional card dates. When the GC arrived it showed an issue date of 2014 and expiration in 2016. We won the USCIS lottery by getting a kind IO, I guess. So we applied now as my wife's GC expires at the end of March.

That sounds absolutely WONDERFUL! I am truly happy for you both, also considering how long they took to adjudicate it.

Our green card took almost as long, but it was indeed adjudicated without an interview, and therefore, the expiration is in Jan 2017 as it has a beginning date of Jan 2015.

I just wanted to make sure I wasn't missing anything, and that you were also doing the right thing!
