SSN application

Hey there wondering if anyone can give me advice on this. Before getting married on the fiancé visa I was a student here in the US and was issued a SSN in my maiden name. I went and applied after we got married for a new SSN with married name, the woman took my old number and started the application. She then calls me back two weeks later and says they couldn't process the application since I am not authorized to work yet. I am still waiting on my EAD work permit and she said once I got that I can go back and apply for one then. Is this ok since it will be out of the timeline that my fiancé visa expires? Does anyone have a similar experience? I want to be able to work as soon as possible - thanks.

Your SSN will remain the same. You will be able to work with the SSN and EAD. You can either just leave it as is and apply for AOS in your married name and then change the name once you get the EAD/AP or green card in married name, or you can go back and use the maiden name to change your immigration status on your SSN over to that of a K-1 entrant.

I think it is less hassle for you to just apply for AOS in your married name and go back and change the name on your SSN when you get the EAD/AP card, since you already have an SSN.

I agree with KayDeeCee, leave your SSC as is for now and focus on the AOS/EAD/AP using your married name. Once you have the EAD/AP or GC you can go back and change it. In my opinion, I would wait for the GC since then you will get a new SSC in your married name with no restriction notes (I.e Authorized for work only).

Good Luck!

Once you get the EAD you can use the old SSC plus the EAD to work, even though it has your old name. I'm assuming you applied for AOS/EAD/AP in your new married name?

Ok but I thought you need both SSC and EAD to work. The green card can take a long time no?

You need the EAD and an SSN to work. You already have an SSN, so when you get your EAD, you can work. It doesn't matter if the SSN is your maiden name. You can go get it changed to the married name once you get the EAD though.

Ok even if the SSN says "valid for work only with INS Authorization" ?

Yes. They now say valid for work only with DHS authorization. The EAD is the DHS authorization.
