Hello guys,

My husband received his CR-1 in June of 2015. According to my reserach, I think we have to apply for his adjustment of status (I-751 form) 90 days prior to June of 2017, correct? It is mentioned that he can become citizen in 3 years. Does his 3 year time start after he becomes Permanent Resident (2017 and onwards) or does it start with his Conditional Residency (CR) (2015 and onwards)? Thanks a bunch in advance! Looking forward to your answers!

It is not adjustment of status you'll chase, it is the removal of conditions. I assume you have been married less than 2 years correct? If this is the case than after approx. 2 years you'll petition to remove conditions.

Once he receives his initial green card, it will say 'resident since' on it. 3 years after that he'll qualify for citizenship

good luck

The ROC filing is specific to the DAY that your spouse entered the US. So...if your spouse entered on June 5, 2014, then you back up 90 days from June 5. If your spouse entered on Jun 22, then you back up 90 days from June 22.

The three-year ticker started the day your spouse entered the US on the CR-1 visa.

Our ROC "filing date" is April 16, 2016, so we are busy putting our package together!

Be sure to use the new I-751 form...

There is no adjustment of status with an immigration visa.

Your husband's residency starts when he enters the US with his CR-1 visa. The day he received it is not relevant.

90 days prior to the 2nd anniversary of when your husband became a condition resident, he must file to Remove the Conditions on his green card.

He can apply for US citizenship after being a resident for 3 years, live with you for those 3 years, as well as the other requirements.

Thank a lot for your reply. So it 5 years total since the day he entered US.
