hi guys ,please I need your opinion. My husband last 3 years was been lived with me in my country -so he didn't file tax for 2014,2013,2012, he is come back to USA this year in november .

We need to send documents to NVC but I am not sure does we need joint sponsor .

So,he was lived out of USA and for this 3 years 1. he is wrote statement why he did't file tax return

2.we have proof that he lived out of USA

3.Proof from guvernment of my country that he never was employed in my country .

He is come back to the States november 1st 2015 and start to work november 23. 2015 ,he have pay stubs and letter from his employer .His salary meets the requirements.
My question is do we need joint sponsor ?How long he need to work that we dont need joint sponsor ?I cant find this information nowhere.

Thank you very much !

Most defiantly you need a joint sponsor. They should have filed last 3 years taxes.

ok but where write this ?only write requirement for meet poverty guidelines and statement if is not file out tax return .

He provides a signed statement that he did not have any income for the last 3 years and is therefore not legally required to file US tax returns.

Follow the instruction for Form I-864.

3 months is hardly a reliable work history. You may want to find a Joint Sponsor.

There is no requirement, it's up to the discretion of the Consular Officer. On VJ we have read a lot about people's journeys through US immigration and can come up with a decent analysis of what may or may not happen in any given circumstance. So, no, the I-864 instructions do not say you need to be employed for XX amount of time. However, the CO likes to see a good work history, not just something obtained recently. It's in their discretion to ask for a joint sponsor if they feel the employment hasn't been long enough or the amount isn't enough.

Also your husband, as a US citizen, is required to file tax returns no matter where he lives in the world, as long as he makes over the minimum amount required to file.

Or when he lived outside the usa from 2005 this rule of filing taxes for all us citizens came active for everyone after this date so. If you moved outside of the usa before 2005 you dont need to file taxes after that date you must. My husband lived with and witout me in the netherlands for 11 years now so when he moved back 2 years ago he filed 3 years 1 on zero because he did not had an income within the us borders and the last 2 years with income because he worked the last 2 years. This with a note to the nvc that he lived outside the usa for so long.
