do you have to submit divorce certificates with AOS i-485 form

Timeline

Visa Journey I-485 Adjustment of Status (AOS) Tips indicates that both birth and divorce certificates are required for the I-485 submission. Can anyone tell me where the divorce certificates go in the package as I do not see anywhere that they are required. Feeling a little confused. I want to submit my package but don't want to send it if I need to include divorce certificates. Please help.

I would probably call USCIS first. I would assume you submitted them all with the I-129f right? It would seem very redundant if they needed them again since the basis for this new petition was from that approval. I would think they would still be part of your file.

I know that I was asked by the IO at the AOS interview to provide the original divorce decrees for comparison with the copies that I had sent in my original I-129F petition. I was glad that I brought all of my original documents to avoid a RFE at the AOS interview.

YMMV.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Maybe I should have had my fiancé purchase a few additional birth certificates. He is only bringing one over because he had already submitted an original at the interview.

Divorce decrees are not required for the I-485, and that is why the instructions do not ask for them. You just need to include a copy of the marriage certificate from your current marriage.

I'm my husband's 2nd wife and even though we sent a divorce decree with our k1 visa package and were already married for the AOS (obviously), we got an rfe requesting another copy of my husband's divorce decree :ranting:

I'm about to send my citizenship package and after 3 years and half of marriage and a son together, they are requesting (AGAIN) my husband's divorce decree <_<

Thank God we requested several copies to the courthouse.

This is good to know. I am the USC and was previously married. So I would need to send with my Fiance's AOS (after we are married) and Citizenship App (after appropriate amount of time) additional certified copies of my Divorce Decree?

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Timeline

Interesting how some people are asked for it, and some are not. The I-485 does not require it. Perhaps some people's divorce decrees did not make it from the I-129F submission to consulate and back to the USCIS A file after POE. Things get misplaced all the time throughout the immigration process. I personally was never asked for my previous divorce decree again, beyond the I-129F petition.

Somebody correct me if I'm wrong, but divorce papers are not required for AOS application. As they were already submitted during K1 application and they already have them on file. However during the AOS interview, there's no harm bringing some copies.

Feeling a little confused. I want to submit my package but don't want to send it if I need to include divorce certificates. Please help.
