Adjustment of Status - time sensitive matter

Hi guys,



First of all I’d like to thank you all for the posts on this website. They’ve helped me a lot in understanding how this whole process works. Let me tell you all a little bit about my case, as normal as it may sound hehe.


I’m Brazilian, came to the U.S. (California) on a student visa obviously to study in 2012. Met my now husband in school in 2013, and started dating back then. We moved in together in 2014 and got married earlier this month! (YAY!!)



I graduated from college in 2014 and started working (in a job that I love!) with my OPT in March of 2015. I have a SSN and EAD card and I pay my taxes. However, my EAD expires in February, and my F-1 Visa expires in June. Theoretically, I have until June to stay in the country but "can’t work a day after" February 14th.



My husband and I are applying for my adjustment of status in February. I’d love to hear some tips and feedback from you guys as of what I’m supposed to do with my situation. My boss wants me to keep working for them at all costs, but we don’t know what to do when my EAD expires. My company was going to sponsor me but since I got engaged and then married, it's definitely a cheaper and "easier road" to just go ahead and try to adjust my status through my husband. Because the cost of the application is so high, we can’t apply for my adjustment of status earlier than February, but even if we did and everything was approved, I wouldn’t receive a new EAD card in time before my expires anyway.



Any tips?



Also, my husband is an U.S. Army veteran, and as of now he has an internship-soon-to-be-hired situation but his income comes from the Montgomery GI Bill (he gets paid as long as he’s enrolled and attending a university). This benefit is not taxable, therefore he doesn’t need to pay taxes as far as I know. But don’t we have to send his taxes with the packet to prove his income? What do we do with that?



Any help would be greatly appreciated!

Timeline

Do you think your company can possibly loan or front you the AOS money so you can get the process started a bit before February so there isn't any issues with you working?

Although your husband's income may not be taxable, he should still have to file federal incomes taxes (unless it's under a certain amount). With that being said, he's a vet and there should be services out there to answer his tax questions basically for free.

10/08/2015: AOS packet sent to USCIS (Chicago lockbox) via USPS Priority mail (They received it 10/10/15).

10/16/2015: Text/eEmails received from USCIS with receipt number. We received 3.

10/22/2015: Received hard copies of NOA's for I-131, I-765, & I-485.

11/01/2015: Got NOA for biometrics appt (for 11/12/15).

11/03/2015: Did WALK IN biometrics appt - took 15 mins. Person taking said work permit should be in mail in less than 4 wks.

12/09/2015: Got email/text notification for INTERVIEW date.

12/28/2015: Got email/text notification EAD card has been mailed.

12/31/2015: Received EAD/AP card.

01/11/2016: INTERVIEW (in Los Angeles office).

01/11/2016: Case in in "CONTINUANCE". Awaiting approval. (Feels like AP).

06/27/2016: I-485 APPROVED - (FINALLY!!!) / 264 DAYS (8 MONTHS 20 DAYS)

07/01/2016: GREEN CARD RECEIVED

I'm sure they would help if I asked, and even my father could help us. But do you think it would matter since it's so time sensitive? Do you have any idea of how long it usually takes to receive a new EAD?

Also, as of the "bonafide marriage" documentation, we have 2 apartment leases on both of our names (from our 1st apartment and our current), a joint bank account, utilities bills with both of our names. He owns his car and I finance mine, which I've been paying for since before we were married. We also have separate phone bills because he's had his in a "group account" or however they call it with a few of his friends and pay SO cheap it's just not worth having a new one with me. We, of course, have pictures of our courthouse wedding but we don't have a whole lot of more pictures of the both of us because he hates taking pictures. We do have a few of us two and some with our friends as well. Is there anything else y'all would suggest we put together to "prove we're the real deal?"

Sorry I'm all over the place, this whole thing is just so overwhelming! hehe
