Timeline

Since you have the interview notice, it sounds like the AOS file is at the local office. Make an info pass appointment, take your withdrawal letter and have them put it in his AOS file. You can withdraw your I-864 at ANYTIME before the AOS is approved. I would strongly recommend getting an infopass appointment before the scheduled interview date.

What happens once I withdrew my I-864 and his AOS? Will he get deported? Can his relatives here in the US help him to be legal or to make him stay? Thanks guys.

He will not get deported immediately.. it takes awhile but it will mean that you are no longer financially responsible for him.

to recap:

1) Send a certified letter removing your financial sponsorship of his i-485 to the same address you sent the original application, forms and to the NVC in MO. (I did this and it worked)

2) Sure the InfoPass would be good to give them the same letter in person, but expect them to say that you can not remove your support, blah, blah, be nice and just ask them to please add it to the file.(Personal experience . Also, I believe you could even go to the interview and tell them in person on that day, that you are removing your support, but that is a risk cause if for some very odd reason his GC is issued, well he has it)

3) No contact with that idiot, none, zero, not even if he promises you his life, just do not.

4) I WILL say this, if you are never served with the temporary restraining order/ protective order that will be dismissed at some point, unless he is that big of a jerk and keeps on pressing. Someone has to serve you that notice IN PERSON, well in most states.

I wish you the best, but to certain extent I agree with another poster, do not dwell on where is or is not, move on with your life, maybe go to some type of therapy, do a new hobby, but move on for your own sanity.

Thanks everyone for all the tips and information. Everything went smoothly and perfect. Did everything you all adviced me. Filed a divorce, wrote a letter to USCIS to withdraw my I-864, made an appointment through Infopass to talk to an Immigration Officer and he can't no longer obtain a greencard in any way nor can stay here legally in the US. Since his case was fraud, there will be removal proceedings now. I'm just glad that this nightmare is over. Thanks to God. Now I can have my life back.

Can you please expand on what happened at the Infopass? It will be useful to other members. Things like how you were treated/what was said/what was asked. If you spoke to someone at the window or were brought into an office. Who you spoke to (not their name but if they gave you their name/rank/job title)

Did they specifically tell you they were accepting your withdrawal letter and that his AOS would not be processed any further?

Did they specifically tell you there is NO WAY he can stay in the US legally any longer? Because thats not entirely true. It is true if things stay the way they are presently- but if he files for VAWA - that is a legal path.

Did they specifically state 'his case is fraud'? Did they review the evidence with you?

Did they specifically tell you he will be going to removal proceedings because of the fraud? Or because his support is being pulled and he no longer qualifies for the AOS he submitted?

Sorry for all the questions. But its quite unusual to have one infopass meeting and be told all of what you posted. Typically people are given a hard time to speak with the fraud dept. officers. When they do get to talk to them (depending on the evidence) they are usually NOT given such assurances. The fraud officer will investigate for a while and sometimes get back to you, sometime you get back to them. Because of privacy issues they do not give you specific information about the case or the status of the investigation however you can generally get an idea of where they stand by what they do say or dont say and how you are treated.

Also- why do you say things are over? Dont you still have to respond to the restraining order or has that been dropped? Please dont ignore it. It can have serious repercussions in your life if it is granted.

Damara. I was lucky I guess for my case since it was only less than 3 months before all the chaos happened with my spouse. My spouse didn't have a greencard yet nor EAD card coz I just recently filed his adjustment of status. Since I have filed for a divorce before we get an interview, it was so easy for them to pull out or withdraw my I-864. I had a talk with an immigration officer and made me write a true statement about his fraud case. I have hard evidence and everything that he had used me solely for immigration benefits. I was told that I don't need to worry about him anymore and Im no longer liable for any financial responsibilities and he can't obtain any immigration benefits such as greencard in any way and he can no longer stay here legally in the US since there will a removal proceedings now. He might try to do that VAWA but since his case is fraud, it would be really difficult they say. You really have to act quick like I did.

She should speak to a lawyer in the state where her ex is, but if she is not personally served in most states it can not become a permanent order. Again, she should speak to a lawyer and NO contact with him or anyone related, known to him.
