Thanks guys for all these infos. I was able to make an appointment with Infopass this week to talk to an Immigration Officer regarding my case. I just really want him to be sent back for all the things he has done and since our marriage wasn't in good faith according to the Bonafide rules. Thanks guys again.

It's very unhealthy to have the mindset to have someone'sent back'.

Marriage didn't work out, go your separate ways.

What's unhealthy is him using her for a visa, lying, scamming, and marrying her promising to love and cherish her until death do they part. Having relatives in the USA she knew nothing about. She has every right to withdraw her affidavit of support and want him to go back to his own country. SHE'S the only reason he got here.

Marriage didn't work out, go their separate ways...which means back to where he came from since he is not able to remain legally.

Sorry but I do not promote illegal presence. Especially, since I've been fighting for over a year to bring my fiance here legally.

Hi LeonessDione. I totally agree with you on that last comment you posted. He should really be sent back where he came from since what he did was all lies or should I say FRAUD for using an american citizen just to come here legally. I can't wait till all these nightmares will be over soon.

Sorry if I got a little defensive for you. I just didn't want you to feel bad for feeling anything you feel. You're 1000% entitled to. He was supposed to come here to be with you, if that ain't happening then he goes back...that's the rule. I wish you a bright and shiny new year with new beginnings, happiness and joy!

1. Wanting him to leave will do u more harm bcos he'll opt to stay illegal, and your wish not coming to pass will cause you pain. You might keep checking up on him on Facebook etc n seeing him do ok will psychologically affect you.

It's someone else's (gov't) choice and obligation whether and when he gets removed. Making it your job will be fighting a losing battle which will stress you out.

2. some US spouses have the notion their foreign spouses may be using then for GC instead of thinking about working on their new family/marriage. And therefore lookout for trivial things that hint their suspicion. This chokes the life out of the marriage.

Marriage on its own is difficult enough, everyone's thinking of what he/she wants.

It's not like in the fairy tales.

3. Whether he used u or not, it's your choice to withdraw everything as suggested by the forum.

4. Yes, there are evil people who take advantage of others.

But I have this stance, partly because it's one side of story, if u hear my ex wife say what caused our marriage to fail, u'd hate me n believe I'm the worst husband on earth n married her to be here.

I'm ok that she kicked me out(in apartment I paid rent) and withdrew paperwork, but I'm not ok with she telling lies to have me removed.

I know for a fact that if GC wasn't a factor, we'd still be together.

5. Again to answer your question, u may withdraw the affidavit of support, he won't be able to get a GC. Unless he gets VAWA approved, so it'll good to stay away from him if he's the type who's capable of framing u up. There's one more way is doesn't happen.

6. It's emotionally difficult, but once u decide to move on, do so, because the more u think about it, the depressing it is.

You are being set up for a VAWA filing. Get an attorney to defend you, make sure you have no contact of any kind with the spouse. That means no texting, no social media, no contact at all. Continue with your plan to withdraw the affidavit of support and report any fraud you can substantiate. Divorce and move on, if they file for VAWA you will have no way to know or obtain any information about it.

I agree with getting a lawyer. However, if they haven't lived together for a while and he is in another state, how much would a restraining order from another state matter?

It's a set-up for making a VAWA case.

OP: You have received great information. Get an attorney. Go to the Infopass with your I-864 withdrawal letter and all of the other evidence you have of his fraudulent activities. Discuss with your attorney the specifics of the restraining order. You may not want to go the AOS interview, depending on the restraining order and its enforcement.

PROTECT YOURSELF !! HAVE NO FURTHER CONTACT WITH HIM, ONLY THROUGH YOUR ATTORNEY!!

If there's an interview, do go but don't lie.

If u go your side of story will be taken into account, if u don't go, it's what he says vrs no opposition from you. And he will say u abused him.
