Applying for student visa while F4 visa is in NVC processing

I have few questions regarding the student visa. I have ongoing F4 visa process (submission of Ds-260 will be done in a couple of days) which may grant me a green card.

The main problem is that i intend to start ms in September 2016. For that i need overall immigration procedure to be completed before june 2016, approximately.But don't know if it will be finished by June. So i may have to apply for student visa if i want to catch the fall 2016 session. It is important , because i got a funding opportunity for the ms. Now the question is if i am eligible for student visa while my immigration visa is processing? Will it be wise to apply for f1 visa before immigration process completion ?? Also can anybody give me suggestions, who went through the similar situation???

My state is confusing , any advice will be greatly appreciated.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Inglorious i think ur f1 processing is faster than f4 cattegories,caus after interview they definetly put u in administrative processing,this is called black hole,my f2b cattegories interview was 2014 june,interview gd,everything ok but they put me still now administrative processing without any reason.

it's not confusing, the problem is that you have to prove that you don't have immigrant intent for a student visa, and clearly you do since you have a petition that is close to coming through, so you will be denied a student visa, they'll probably tell you to wait until you get your visa to apply for university

My 2 cents; go with student visa first. If your immigration visa is in progress, it will be really difficult (if not impossible) to obtain student visa. All the other suggestions from others are good

read the OP, he already has a petition that is at the NVC stage, he will be getting a visa in matter of months

at this point a student visa is useless

Don't even bother with a student visa. It's a bad idea for several reasons.

1. F1 student visa requires you to show that you have a foreign home that you intend to return to after finishing your studies. You will not be able to do this with an immigrant visa application. People who are advising you that you can get a student visa with a pending case fail to distinguish that those people have pending cases but have not filed for immigration visas because their cases are years from being current. You are different since you will be applying for an immigration visa in a few days.

2. International student tuition are extremely high. Why would you want to pay that when you can soon pay in-state tuition with a green card? Why pay $40,000 when you can pay $15,000?

1. I know what you are saying. The main problem is that i may get funding opportunity for fall 2016. That is why i am thinking about student visa. Otherwise i wud apply in universities after immigrating in US.

2. Yes , that is true. The thing is the RA offer comes with full tution waiver + monthly stipend. I may miss this opportunity if i wait for the immigration visa.

However is there any chance of rejection of immigrant visa based on F4(i am derivative beneficiary)??? If any i will lose both advantages.

Hi aleful, thank you for your reply.

What you are you saying are most likely to happen. Still i wanted to know because of the funding opportunity. Also if i go to US before completing the immigration process things may get complicated to obtain the green card. I may have to pass the assistantship offer. Again thank you for your time.

Sorry to hear about your situation. Incident like this makes me unsure about the immigration process which is why i thought of applying for student visa.

hi

how old are you? if you are completing the paperwork in your name, then you are being considered as a minor under 21.

I am 24 year old , however according to cspa my age is 17 year i think. I see my name in the CEAC portal, in applicant's list.
