im filing I-130 for my husband. I'm a US Citizen been waiting for 4month for approval. waiting is killing me. wondering if I go back to Nicaragua where he is at and stay there till the process is done how will affect my case?
do I have to be living in the US while waiting?

I will also be the sponsor?

hi

the petitioner is always the primary sponsor and you will have to fill out the i864, if you don't work or you don't make enough, you can have a joint sponsor

the petition takes about a year, but you can visit him and stay for a while

the thing is that I was told that I have to be working or have and current income at the time of the process. otherwise it will affect the petition. and also I was told that I have to be living in the U.S.

Honestly I want to go backhome and stay with him until his visa is approved so we can come to the U.S. together.

being apart from each other is unbearable and is hurting soo bad. :(

In order to get your husband a visa, you need to meet the I-864 Affidavit of Support requirements. One requirement is that you have a US domicile. The other is that you or a Joint Sponsor must meet the financial requirements.

A US domicile is your place of normal residence that if you were to leave temporarily, you intend to return to it. So, you will want to maintain your US domicile if you want to leave to join your husband.

You will need to meet the financial requirements (typically, income of $20k for a family of 2 people - you and him). This has to be from a current source of income. It can not be from a job that you no longer have. If you can't meet this requirement, you can get a Joint Sponsor who does.

You need to brush up on these two requirements and how they can trip you up if you choose to go stay with your husband.

Lots of people on here choose not to go abroad because they need to stay to meet the I-864 requirements.

What Happened if I met the I864 requirements for 2015. I made more than enough. the problem or my concern is that if I leave the us I will lose my job and I just want to know that if at the time of interview I the petitioner / sponsor will have to be working and getting a monthly income. I am a home owner so of course I will have a US domicile. i'm just wanting to go with him cuz I miss him a lot and is hard to be apart.

Yes you need current an ongoing income at the time of the interview- even if you made three times the poverty level in 2015, if you do not have a current job at the time of the interview, you cannot sponsor him alone.

Is there a friend, family member or maybe co-worker or church family that would be a co-sppnsor?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
