Hi guys,

I've been reading up on the next steps and see that my American husband (who currently lives in Germany) has to prove his intent to re-establish US domicile in order to qualify as my financial sponsor.

He is currently applying for jobs in the States, has US bank accounts and can show recent US tax returns. He has been living and working in Germany for the last 5 years, but in the American military so earning in US dollars. We have online quotes for shipping our possessions back, as well as online quotes about flying our dog back. Also a letter from my mother-in-law stating our intent to move back and that we can stay with her.

Any idea what the Frankfurt office (or other ones) requires to fulfil this section? I've been reading through the forums and it seems this is a point some consulates can be very strict on!

Thanks, any tips appreciated!

Not a big issue. I attended the DCF interview (im the USC husband) and got interviewed myself bleh and i just told them that we were planning to stay with my parents while i job-hunt. The tax returns had a foreign address but our bank account was in the US. They didnt give us a hard time at all.

When we actually left i already had a job and apt arranged and we corrected the address for the green card at the airport when we landed. I did not have a job before the interview, too early to search.

We didnt have quotes for moving or anything like that, we just had to tell them what our plans were.

I don't think that domicile is an issue since he's military. The I-864 instructions state that one is considered domiciled in the US if employed by the US government (p. 5). I presume this covers military members, but double-check. (We're not military, so I don't know for sure. I couldn't find it specifically addressed on Frankfurt's site.)

Actually he was a civilian working for the airforce, and his contract expired in Sept this year and he's no longer at the base. So I don't think that he is still considered domiciled in the US. How did you prove your intent to re-establish US domicile? I've double-checked Frankfurt's website, but it's quite vague, and short of already having a Stateside job, house and car, we're not sure what they will / won't accept...

We have not yet filed, so I can't tell you what we did, sorry. I have been watching this process for a while, as we thought a couple years ago that we might be moving, and have gathered some links. Hopefully they'll help.

Domicile is addressed on this USCIS FAQ page: http://travel.state.gov/content/visas/english/immigrate/immigrant-process/documents/support/i-864-frequently-asked-questions.html

London has a nice chunk about it on their site: http://london.usembassy.gov/faqs-i864.html

The NVC wiki here has a sample domicile letter: http://www.visajourney.com/wiki/index.php/NVC_Process#Step_6_-_Gather_AOS_Package

Thanks so much for the links, the NVC wiki sample domicile letter is especially helpful.

I find it quite funny that you need to go to so much effort to prove your intent to establish a US domicile. Why would you go through all the stress and hassle of a Visa application if you didn't intend on moving there?!
