he said he provided PCc of the countries where he lived but now after tgat he is saying he lived in pakistan only OP you sounds like confuse before asking help from people here you need to provide complete details about ur past and present

At this point the USC should contact her/his senator and inquire through him where you case is located at.

If still at the embassy have him request a second interview, long shot and rarely granted.

If the senator gets feedback that your petition has been returned to USCIS (request diplomatic pouch number if it has been returned)

then it will be purposely allowed to expire.

So if the embassy does not answer your question then inquire via the senator exact case location and potential return.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Getting married will not alleviate the reason, as yet unknown, for the refusal.

And for the record, what happened in California, the deliberate killing of 14 people, and wounding 22 others, can hardly be referred to as a mishap. It was murder.

Full Definition of mishap. 1 : an unfortunate accident. 2 : bad luck : misfortune.

I can explain it to you. But I can't understand it for you.

Atif799 you should be ashamed of yourself for making judgments .your posts are harassing me and are disturbing.I am a educated pakistani citizen with decent job , i never had any criminal record whatsoever.I am going through pain misery and stress.I wish u the same situation to know how its like. please for what ever sake who u believe in PLEASE YOU DONT COMMENT anyfurther.

I suspect we'll be seeing quite a few petitions from Middle Eastern countries being put straight in the bin in light of recent events, or otherwise put into a state of perpetual limbo if outright refusal is too bothersome.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

I put a post to know what we can do after refusal ,reapplying K-1 or to get married.

how we can fix it and take it forward after refusal.can we ask for re interview or the case will be sent back to USCIS.my passport is with embassy ,how they will contact me,i dont have any refusal letter ,why they refused me , i called embassy but they dont entertain phone calls , i emailed the and got no reply .Dont know whats goin on. stay blessed every one.

You need to know why it was refused (different than a denial). Did you have an overstay? Test positive for a banned illness or drugs? Background check - something is questionable? Social media issues?

Your petitioner will need to contact their Senator.

At this point, there is nothing you can do. Your file will be sent back to USCIS where one of the 3 scenarios will happen (ranging from most likely to least likely):

  • USCIS will sit on the file and allow the petition's validity to expire. They will then tell you can start over at square one by filing again (they will not reveal the reasons behind the visa denial by the Embassy).By saying petition's validity to expire, u mean my NOA-2 expiration ??, it was expired last month and i did inform the embassy about that.
  • USCIS will send you a Notice of Intent to Revoke (NOIR). An NOIR will specifically state the reasons why it is being sent along with a deadline to submit a rebuttal. An NOIR rebuttal must address each of the reasons in the notice itself. If the original approval of the petition is reaffirmed, it will be returned to the Embassy for another interview.Can we have another interview for my K-1 case ?. Proper response to an NOIR does not guarantee reaffirmation nor does reaffirmation guarantee a visa will ultimately be issued. But if its this scenario how long it take since my NOA-2 already expired.Also my passport is with the embassy
  • USCIS will reaffirm the original approval of the petition without needing anything else from you and return the file to the Embassy for another interview.Any time frame for that?

Plan on the first scenario happening, not the second or third. From what others have posted, it's extremely rare for USCIS to take action on a returned K1 petition when they can simply just let it expire.

You won't get a NOIR letter, only CR-1's do. When K1's are denied they just go back to USCIS and expire.

You need to find out where your case is. If it's still at the embassy you have a small chance of getting another interview. If it's at USCIS there's nothing more you can do for this K1. You need to figure out why you were refused so you can fix it and either file 129F again or get married and file CR-1. But there's no point in doing either before you have figured out why you were denied or you risk being denied again.

no overstay ..i dont do drugs ,dont even smoke cigrette,no criminal record
