Sometimes it can take 3+ months after stokes to be approved.. also, you could very well get a home visit

From what you said..You will not be denied...you will be approved but it is going to take a long while...or you will be asked for more evidence of bona-fide relationship. Be patient..

You have no way of knowing whether they will be approved or not; those kinds of blanket statements are ill-advised.

Cases like this tick me off because it sounds like you guys are a normal married couple.

I believe that you have 30 days to appeal a NOID if you receive one. Please retain and keep a good, experienced immigration attorney until this is finalized and good luck to both of you.

I see you mentioned Sacramento..... whats is the race of the interviewer? I had been in Sac, then SF and LA... and in LA it was hispanic OP... while SF some are Chinese OP. SF and LA, much easier if your OP had immigration backgrounds ie.2nd or 3rd gen immigrants.

hi,update.

today we got a letter,

it was weird, it was neigther RFE, nor Intent to Deny

it is :Continuance.

the USCIS asked me to provide 11 kinds of documents,

such as affidavit from join sponsor, landlord, roomate,

letters from employer (I and my wife)

bank statement, insurance documents ,utility bills, marriage photos, ring, affidavits from everyone from the wedding.

luckliy USCIS give me 87 days to prepare.

I want to collect all the required documents asap, BUT BUT BUT,

I just on board as a software engineer 2 weeks ago, I even do not get paid,but USCIS needs my 3 months' latest pay stubs ,

so do I need to wait for 2.5 months, get the pay stubs ,after that, then submit around the deadline? any suggestion?

That's an RFE, even if it wasn't labelled as an RFE.

The giveaway is the 87 days given to respond, which is the typical timeframe RFEs are given.

you guys are both from the same culture and similar in age ect so i find this pretty surprising you would be a stokes interview.. not sure what sent them off? I feel as though if you are not native to the english language, that is a huge barrier in answering many of the interview questions and i know certain cultures act a different way, so i feel as though this may be the reason, how you acted during the first interview?

I think you will be approved (it could take a while)... but you can only renew the EAD while the AOS is pending. if it gets denied your EAD is invalid

Eh - I take the opposite posit,

USCIS will put more scrutiny into this. Why? USCIS is looking for the 'arrangement' now because of prior folk doing exactly the same thing.

you already have your answer. If you have seen chinese and hispanic OP or VO, very different story .....

Staff with immigration backgrounds know the difficulties while the people that grew up here not know what hardships people go thru, only attend USCIS training to catch fraud etc, jump at anything they overly concern is fraud....

sorry - forgot to mention -

1. most of this stuff is from the I-130 instructions, the 6 types of evidence to prove up a bonafide marriage.

2. some of this stuff applies to your uscitizen spouse. some is 'as well', some is 'absolutely not you, you cannot give over that evidence, she must, instead'.
