Hello ,everybody.

I just completed the Stokes interview,not good ,now I am very worried of NOID/ Deportion.

I came to US with F1, met my US wife last year,filed 485 this August, we are both first marriage, no child.

the first interview was processed at Nov,

it took 10 minutes, OP just asked pretty basic and simple questions (we sit together),then she said she need time to review,

after 3 weeks we received a letter: followed up interview,

we checked online and found it will sure be a separarte stokes interview, so we prepared a bit.

the second interview was handled by a mid aged lady,this time we hired a competented attorney with us .

OP first let me entered the room,

then I saw she began writing questions and answers.

my round took 45 minutes, about 28 questions.

all both basic questions,

but but but I was very very very nervous people,

at last we had 2 questions discrepant,

(1) what did you have dinner last night

I was very nervous that time so I mistakenly head to : last time.

in fact last night we did not have dinner together,my wife worked at hight,so I picked her up at midnight then we went back home and slept.

so I answered the menu we had last time, but but but my wife answered: we did not have dinner together

(2) Did you have trip before?

I was also very nervous ,I mistakenly thought it was: honeymoon, actually we are both busy we do not have it, so I said we do not caz we both work hard .

however, last week we togher went to the Sanfrancisco ,golden beach. we even took pic of both us. so it sucks : my wife answered: of course we had a trip to the Sanfrancisco last weekend

After that,the OP said there were 2 diff, asked my wife why? can you explain(only asked my wife not asking me,I was waiting outside),my wife explained the second ,said I might thought it was honeymoon and showed her the pic we took, the OP said:

she needed the affidat from every one showed up in our wedding ,including address, cell no.

and let us left she needed to review.

Now we are both very worry, we checkd online, if there are discrepencies in the 2rd stokes interview, USCIS will issued the NOID.

so will the OP denied us based on the 2 discrepanies?

Could anybody give us some suggestions? we already had a attorney.

the attorney said dont worry, if she wanted deny you, she wil do it on the spot, she didnt means now you still have hope, she said she

had some experience, some clients got denied just after the comparing results of the 2rd stokes.

what should we do now? collect the new evidence? we had more than 100 pictures : different place,time, with both our close friends. lease recept, join bank statement.

There's not much you can do about it now. It sounds like it could go either way. Getting questions wrong on a Stokes = bad.

Not denying you on the spot means nothing; your attorney is an idiot for even suggesting that.

Wait for the decision and proceed from there.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

situation was worse than I imagined,

now I can only wait to see how things goning on, wish No NOID coming

There's not much you can do about it now. It sounds like it could go either way. Getting questions wrong on a Stokes = bad.

It is somewhat unusual you had a Stokes in the first place, your basic story and length of relationship are quite normal.

What did your lawyer think?

Did you have a big wedding and reception, were you able to provide many names?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

we had two interviews, first together, only 10 mintes,3 weeks second was stokes,45 m each .

laywer thought no big problem ,let us to be normal , just waited for the mail to see what going on and then take corresponding respond.

we had a reception ,took 2 hours,25 p attended ,our both side close frds, her family members.my parts were in China so they did not attend it .

It is somewhat unusual you had a Stokes in the first place, your basic story and length of relationship are quite normal.

How old are you guys and what culture are you from? I am just wondering why you got a stokes interview in the first place and what set them off after the first interview...?? How much proof did you bring of joint accounts/pictures ect?

My guess is, it is because you adjusted from an F1 is why you got the stokes, but i could be wrong.

I am 30,my wife 21,we both asian.

I am F1, but I came into US in March 2014, completed the master degree this August.we met at August last year

plenty of B1/B2 applicants went to the US and marriaged instantly and got approved in the spot, so this really anoyed me.

Now I even got a high-paid job as a full-time softeware engineer in a reputed semi-conduct US company, I had to renew EAD each if USCIS keep pending us,or just

denied us recently.

How old are you guys and what culture are you from? I am just wondering why you got a stokes interview in the first place and what set them off after the first interview...?? How much proof did you bring of joint accounts/pictures ect?

My guess is, it is because you adjusted from an F1 is why you got the stokes, but i could be wrong.

If your EAD is based on your AOS and the AOS gets denied your EAD is no longer valid as of the date of denial and you would have to stop working.

This will not be over quickly. You will not enjoy this.

forgive my thinking of our case too seriously, my wife appeased me and said we need not to worry, but I really worry, she had a poor salary , but I tried my best ,took great effect to pass the (employment)interview and get a good fruit in a reputed software company, I need to pay our bills to support us to live.

I really wish not get the job lost and deported at this spot.

If your EAD is based on your AOS and the AOS gets denied your EAD is no longer valid as of the date of denial and you would have to stop working.

you guys are both from the same culture and similar in age ect so i find this pretty surprising you would be a stokes interview.. not sure what sent them off? I feel as though if you are not native to the english language, that is a huge barrier in answering many of the interview questions and i know certain cultures act a different way, so i feel as though this may be the reason, how you acted during the first interview?

I think you will be approved (it could take a while)... but you can only renew the EAD while the AOS is pending. if it gets denied your EAD is invalid

I think you hit the point, my wife native language is English,

our first interview is very normal,prety basci question: birthday, when met, when wedding, when and where live together etc,

less than 10 m then OP said this interview completed and let us went.

You are not denied until the decision to deny is made. The NOID is a warning not a denial.
