Hi everyone.

I am a USC and applying for for I-130 and AOS concurrently. I just moved back to the US (1 month ago) found out I need to file my taxes for the last 3 years while living abroad. I have all the info and understand how to do this part.

1st. When I file my taxes it will take some time to be processed, should I wait a few weeks after I file before sending in my packages for i-130 and AOS, or can I just go ahead and send in copies of my returns?

2nd. My income was very low in US dollars in Brazil, (avg. 9000 dollars ) per year the 10 years I lived there with my wife of same time. I just started a job here in US. making more than the poverty guidelines for our family. Will a few pay stubs and a letter from my employer be enough. I will have a joint sponsor thank makes more than enough.

6/2005 we met in Brazil, I returned to US we stayed in contact.

9/2005 returned to Brazil asked her to marry me. :dancing:

11/2005 moved to Brazil and got married.

6/2006 daughter born in Brazil.

11/2006 took wife and daughter to meet my family in US.

10/2012 vacationed in the US 3 months

3/2014 2nd daughter born in Brazil.

11/2015 visited US again

12/2015 decided to start AOS.

4/4/2016 mailed AOS package

4/6/2016 AOS package received.

4/19/2016 received text AOs received and checks cashed

4/23/2016 received hard copy I-797c for I-485 and I-130

4/29/2016 received biometrics notice, scheduled for 5/10/2016

5/10/2016 Biometrics done, Nashville Tn.

5/20/2016 Received RFIE on I-485

5/31/2016 mailed response for RFIE

6/6/2016 NBC office received response to RFIE

6/13/2016 received notice that case is ready to schedule for interview.

6/22/2016 received notice for interview set for 7/25/2016

6/25/2016 received hard copy in mail for interview

7/25/2016 interview AOS approved.

7/28/2016 received I-797 for AOS approval

You can send application now as it takes time to get application past USCIS and to NVC NVC will want to see tax returns but you can replace this with W 2's as per instructions on support form. Still need to file the taxes for the income in Brazil

You don't say how long you are here in US and the length of time you have been working and earning a better living may affect needing a joint sponsor. A freind of mine was here only 2 months working as engineer after graduation and needed joint sponsor. he was a USC studying abroad for the last 2 years.He also had to provide a criminal investigation from the country he had been in for last 2 years as you will need one from Brazil.

You'll need the tax records some 3-9ish months after you file the I-130 depending on how fast you go through USCIS (it seems to be about 5 months on average, less for some, more for others) and how much it takes for your case to then get transferred to the NVC and how long it takes for them to process the fees (about an extra month or so), so I wouldn't hold off on filing on that count.

As I stated in my post I have been back in the US 1 month.

I do not have and will not have W2's because I did not work for a US company , I was self employed in Brazil.

Filing taxes for the income from Brazil is not a problem I understand how to do this.

I will have a joint sponsor.

Why would I (a USC ) need a criminal investigation and how will I know? How can I get one while here in the US?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If both you and your wife are currently in the USA, she will NOT need a CR-1 spousal visa, because visas are used to enter countries. The path to a greencard fro her is instead Adjustment of Status (AoS for short), from whatever visa she came on (B2 tourist? TN work visa?).
