06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Last June she was suppose to go but due to the the obama administration which was soft on deporting people that were suppose to be deport she apparently was not a top priority for deportation. She had also tried to appeal but since she did not have the full understanding of timelines she failed to meet those deadlines and the judge denied her appeal. The denial of appeal was mainly due to the fact she did not reply back in a timely manner,

 

I am not sure if you are aware that when you are in deportation status you are required to check in with the local office and they were schedule to check in every 6 months.

 

A week and a half ago the oldest daughter got called by an agent with immigration and she asked her if she and her sister would go to the local office which they did. The oldest called her mom and told her they needed to go to the immigration office but she did not tell her what for and they detained them.

 

My daughter and I was called to let us know they were being sent back and I was able to bring my daughter over to where they were being held so she could say her good byes.

 

Apparently the new administration especially in our area are not playing around. There have been numerous articles about immigration ramping up and apparently they are.

As you said yourself, she wasn't a priority for deportation. She didn't have a criminal record. It could be that her number came up, and regardless of president, she would have still been deported this month.

 

Obama deported more immigrants than any other president.

 

It takes resources to deport someone. I prefer those resources are dedicated to violent criminals. Failed marriages and women with kids can wait at the back of the line.

Personally I feel what happened would have happened differently under Obama. Under Obama people who did not have violent offenses were allowed to be 'deported' by a Judge (deported simply meaning the Judges puts in an order of deportation for them)- so they would have an active 'youve been deported' on them, but they didnt have to actually leave! They would just check in every 6 months like the OP stated above. Obama was looking the other way so to speak. 

 

I cant remember the exact number but it was shocking high of how many people have active 'youve been deported' orders against them and havent left and have been checking in with the government. Many of them have gotten stopped when going in to check in. Others have taken 'sanctuary' in churches and other locations and not checking in. This is because of Trumps orders. He says if you have a deportation order then you must go. Doesnt matter if you are violent criminal or not. 

 

I understand your position of priority to violent criminals going- and I totally agree they should come first. But on the other side of the coin theres space between having a policy of: everyone who was deported by a judge MUST leave and - not being deported AT ALL. Obama was not at all. Trump is every single one. 

 

What I find horrible about the whole situation (and this has happened to hundreds of families besides the OP) Sometimes the 'mothers' who were deported stay. And the longer you stay, the harder it gets to leave.So when they are now forced to leave its devastating to everyone. In that way- I prefer Trumps policy. Its like pulling a band aid off quickly.

Im pretty sure you guys have a daughter together right? Im not sure about sending the girl to the PI. Your ex might be bitter about everything that has happened and may attempt to keep your daughter in the PI when she comes to visit. The girl would be a dual citizen. Often in those cases when the child citizen is in a country of citizenship THAT country takes priority. 

 

The PI government will consider her a PI citizen basically and may not honor your US custody paperwork. Speak to an attny if you do travel (before). But its more likely your ex will soon fall in love again and find a K or CR visa back before you can blink.

Incorrect that Obama was looking the other way. I can cite numerous cases of people who had no criminal record deported under Obama. 

 

Its about priorities for deportation and resource allocation. These people you reference were considered "low priority". That doesn't mean NO priority. There have been very public cases in the media of low priorities for deportation being detained at a check in and deported-under Obama.
