Joint sponsor letter from employer

Hey, guys!

I've looked for this myself, but have only went in circles.

As a student, I have no income; therefore we're using my mother as a sponsor. My mother works for the government and when trying to obtain a letter from the employer, she was told by the HR that she could not be given such a letter, because nowhere online does it state that a K1 requires this. The woman in HR went onto say that if it were my mother's fiancee, they would do it, but the fact that it isn't means it's a liability issue and that they could lose their jobs. In short, this person says that if we can prove her otherwise, from a government source, of course, then she would be willing to give her the letter. I have looked on uscic.gov, looked through the instructions of the I 134 form, and have not seen anything that is suitable as proof. My fiancee's interview will be taking place in Frankfurt, so I also looked into that as a possible source. Frankfurt's check off list mentions a joint sponsor in the portion referring to tax return documents, but states nothing about a joint sponsor for the I 134. I could show her the instructions for the I 134, as it clearly states that a letter from the employer is needed; HOWEVER it doesn't SAY you can have a JOINT sponsor, which is the issue! I hope this message makes sense. I attempted to explain as best I could! If anyone could help me out, I'd greatly appreciate it!

The only thing that she needs to ask for is a letter of employment. They don't need to know why it's needed. It just needs to say XXXX is a permanent employee and has been employed since XXXX. Her yearly (or monthly) salary is XXXXXX.

The employers have nothing to do with immigration. People can need an employment letters for a number of things. It doesn't have to say anything about immigration- it just needs to verify her name, that it's a permanent position (meaning it's not a contract job), and how much her salary is. It would help to be on company letterhead and signed by HR. At no point would that give the job any liability unless they lied on the letter, which would only have liability on you and your mom's credibility.

I work for the government and they had no issue at all with doing this for me, nor did I tell them what it was for. My joint sponsor also works for the government and actually got one upon employment as an official job offer letter.

Look at that link under "Supporting Evidence" letter B. It is a very much needed part of the evidence.

A joint sponsor is required to fill out the same form and do the same things as the primary sponsor.

It states:

Joint Sponsor

A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement.

I am in agreement with everything you've stated. I do not understand why this person insists on making something seemingly simple into something difficult.

I believe we will just resort to using the letter she received upon starting there, in addition to pay stubs and hope that that will suffice.

I think as long as she has the letter from the start of her employment and has the pay stubs to corroborate, you should be fine. Just make sure that letter has all the necessary information.

Just a thought- have you maybe tried another HR rep? Maybe you could get a bit further with them? Or maybe the HR supervisor?

Okay, we will definitely do that!

Apparently the supervisor advised the HR rep not to do the letter.

Thank you for mentioning the initial letter of employment, though! I was so blind sided by the HR's response that I didn't even consider the alternatives!
