I cant believe what's happening to me.Tuesday I went to a SSA office in Florida,to get a ssn on my new name(i married 2 weeks ago).The person who i spoke to told me that i can't have a ssn on my new name because i was married ,so now i'm not a k1 so i have to wait until i have an EAD to obtain a ssn on my new name,but she can still give me a ssn on my maiden name.Yesterday i found out that she rejected my aplication(she didn't give me a ssn at all).I have documents that prove that she's wrong.Me and my husband called today this ssa office and talked to another person,missis BRENT,who was very uncooperative and condescending,she did't want to help us at all.She didn't even want to listen to our explanations,telling us over an over again,and interupting my husband,that once married,a dont have a right to a ssn because i dont have a k1 status anymore.I dont know what to do.I'm considering the idea of going to another ssa office and trying again.

It's unbelievable!

The name of the person who rejected my application(after telling me that she will give me a ssn on my maiden name-deceiving and lying to me) is MACHETTA.

Is you're I-94 still valid? Perhaps that's why they didn't give you an application for a card. I applied a week after I moved down and received one a few weeks later. This is before marriage I'm speaking of. I know it's too late for you to do that right now, but just wondering if you're I-94 hasn't expired, and that's why they're saying you can't do anything until you have your EAD or Greencard.

my wife and ai went to the ss office the day we got married. the person there registered her first as not married, then she chenge it as married the same minute. we never had any problems at all.

This is the same thing they told us, they would need verification from the USCIS. We went back when Claudeth got her EAD in her married name and it took about six weeks to get a new card with her married name on it.

My i-94 is not expired.It expires in almost 2 months!

I have another question as well:on the forms for AOS &EAD ,I want tot put my new name.Do i just put my new name there,even if i dont have an ssn on this name,or dont have an ssn at all?Do i have to prove my new name?(on the marriage licence it is the maiden name,i was told to write my maiden name and chenge it afterwards.)

Just put your new married name on the AOS & EAD docs, as long as you are using the same last name as your husband there will be no problem as his name is also on the Marriage certificate. This is what I did and had no problems and all NOA's came out in my new married name.

You don't need a SSN to file these forms.

I just went thru all of this. It is ashame how misinformed some of these workers are. We first got my wife her card with her Maiden name and then after we got married we applied for her name to be changed to her married name. The office seemd ok with it, but after a few weeks going by no card came. We came back to the office and they said that the system would not allow this to be done. She filled out a form and send the application to our local USCIS office. I don't know what the form was, but after a month we got the new card with her new name.

We were able to use this to get her a State ID card as well.

You can write her married name on your application, even though she doesn't have a card to prove it. That is what I have been told by a few people on VJ. You will just list her Maiden name on the application where it asks for other names used.

I can't believe that people are not aware of this high probability problem from reading the posts here on VJ. There's a new thread on this experience every day.

As zyggy recommended take off your wedding ring, go to a different office, apply in your maiden name, and keep your mouth shut about having married. (Note that SS-5 nowhere asks about marital status.)

If they can't find it or show it to you, ask for the manager to sit in on the conversation. When I asked the lady to show me the policy that showed that my wifes K-1 status changed after our marriage, she couldn't find it and continued to process our application. She even agreed with my logic of, what good is a SSN in her maiden name? Also, print the papers showing that a K-1 is work authorized, bring them with you. Now, if you already filed the I-485, then the K-1 status has changed to pending, just tell them that you haven't filed yet. Hope this helps, I know how frustrating the SSA can be.

I went today to another office,and i didn't show them my marriage certificate.But of course,they find my application in the computer.They told me that they can't do anything,and that i'm no longer a k1,because i'm married no,so my status is k3 :blink: I cant believe how stupid they are.They showed me a printed document with al kinds of visas (b1,b2,k1,k2,k3 etc) and next to the visa their meaning(ex. k1-fiancee,k3-spouse) so,after their stupid judgement,now i'm a k3, :wacko::blink: and i have to obtain an EAD to in order to have an ssn. :blink:

I dont know what to do now,really.Can anyone help me with an advice,or if there is someone who went through this,how did you solve this?Does anyone have a document (official preferably) that shows that i'm still a k1?

Humm... I had gone into the SSA office the day after I arrived and the first guy gave me trouble til I insisted that because I am a K-1 I am entitled to a number. Luckily my name was in their system. 2 days later I was married. I after 3 weeks hadn't gotten my SScard yet so called and was told to return to the office. I thought I would kill 2 birds with one stone and change my name at that time. But, the lady working at the office that day stated that the SSA "SAV" program automatically verifies your name with USCIS so unless you have changed your name at your local office to reflect the marriage (by filling out that form someone else mentioned or filing your EAD) they can't verify your new name and therefore can't issue a card under the new married name.

If people don't say at which SSA this stuff is happening it will never be corrected. So if an SSA office comes off with some BS you know is wrong please say where it happend, i.e. City, State and street if there is more than one SSA office in the area

They said that you're now a K-3? What a load of BS. You should have asked them for a new American visa, if that was the case. Go back and ask for a manager or go to another office. You are a K-1, you are whatever is on your visa, only the state department could change that, and they never would. As long as you have not sent anything to USCIS, you are a K-1. Iquit has a point, something does need to be done about the SSA'a.
