you can make trips to Canada and Mexico without a passport and get back in using other ID's

Ok. Presuming that the OP has an enhanced ID.

Now what are the chances that a young single Filipina will get a visitor visa to Canada or Mexico?

Wouldn't it be easier for OP to make a payment plan for his unpaid child support, get his passport back, and go meet in the PI than to go chasing this unicorn?

Ok - back in 2004 - 2007 I was out of work and had a "VERBAL" agreement with the exwife to not worry about refiling the court ordered child support since I was out of work.

LONG STORY SHORT..... she filed for failure to pay child support for those 3 years in 2012 after she got divorced from her remarriage and judge ordered arrearage payments + penalties + interest etc.... in the sum of 80,000.

I HAVE NO PASSPORT and will not be able to obtain one due to the State Dept revoking my travel abilities due to the child support debt.

I've been "seeing" someone in the philippines on Skype for the last year and a half as well as daily email, etc... however I have no ability to meet her PHYSICALLY.

Would this constitue a hardship? If not then there truly is no such thing as a hardship short of complete paralysis or being in a coma.

Nope, not a hardship. Your best bet is to pay down the back child support to the point where you can get your passport back, and then travel. It may take a few years or longer to do so, but this is what USCIS will expect you to do.

Unless you are bed ridden and unable to physically work or travel, there is no chance in getting a hardship waiver.

Another tidbit of information for those unaware. Once your passport is revoked due to past due support (which happens once you surpass the $2500 mark) the ONLY way to get the revocation removed is to completely and totally clear the entirety of the past due amount, not just pay it down to the $2500 mark, but to pay it off completely.

Another HUGE thing to remember, if you don't make arrangements with the DHHS of the county the support agreement is out of, your ex can go to court and request a judge to find you in contempt of a court order, which will have manditory jail time, unless you have an extremely good reason for not fulfilling your required obligation, and a verbal agreement between you and your ex does not exclude you from court ordered support payments.

also, never trust your Ex, they are an Ex for a reason.

FWIW, I was in the same boat with being in arrears with my support payments to the tune of 25k (long period in my life where a lot of bad stuff happened and I was unable to pay), but as soon as I stabilized myself I immediately contacted DHHS and started making additional payments to clear the amount, so that I could get my passport, and go to visit my fiance. For many months I dedicated every penny from my paycheck that wasn't required to feed myself or pay a manditory bill (Rent, Utilities, ect..) to paying off my past due child support. I was literally living off of $50 every 2 weeks as I drained my savings and each paycheck to make things right.

Take the advice from a guy who was actually in your shoes. Fix your child support problem if you want to move forward with this relationship.

Fat chance that your fiancee will be able to get a visitor visa to Canada or Mexico.

Unfortunately, the Philippines does not hold any travel visa waivers for North American countries including Mexico and Canada. At best, Filipinos can visit approximately sixty countries worldwide with no prearranged requirements (many of which are in Asia).

To all the folks saying I need to pay my child support - the child is 19. Child support is done. Its the arrears plus interest that are holding me down. It was 80,000 about five years ago - its down to 22k now... but payment plan to repay or not is irrevlevant.

Once you owe more than 2k - your passport is REVOKED until your balance is ZERO. No payment plan - and NO BALANCE. Then you get your passport back.

How this is legal - dont know.

But it is possible for her to go to canada and all I need is birtch certificate/dl to come back.

Enhanced D/Ls do not exist in California yet.

A repayment plan is necessary and not irrelevant as you have stated. Once in the DHHS database, the state where you owe child support would need to okay you being taken off by you paying off the balance or with a repayment plan. It's up to the state to decide if you can be taken off the no passport list.

How can you get (or reclaim) a U.S. passport if you owe child support?

You will need to contact your local child support agency to make arrangements to pay your child support debt or otherwise reach some satisfactory agreement. If you owe child support in more than one U.S. state, then it is likely that all of them reported your name to the Passport Denial program. In that case, you will need to negotiate with all of them before you can be cleared to receive a U.S. passport.

To find the relevant agency, see the “State Child Support Enforcement Agencies, Department of State Contacts” list on the DHHS website.

Once you have paid off the child support debt or come to some satisfactory agreement, the state(s) in question will request that DHHS remove your name from the database list. This typically takes two or three weeks.

How is this legal? Well it is the law and people leave the country to avoid paying for stuff so that's their way of making sure you have an incentive to pay...

But yeah, it isn't impossible for the two of you to meet so to answer your question: nope, waiver is not possible.

I have come across lots of things coming to the US that fall into the OMG category.

My favourite story involves a guy whho did a runner on his wife and 2 boys. many years later he has a new family and is living in Florida

He passes away and his old family get to here about it, 100 grand comes out of the Estate in child support arrears.

Ha. Everyone says you need to be immobilized and bed ridden to get the waver. Try having your wages reduced by 60% (the legal limit in calibfornia). (Yes I said CaLIBfornia)

If your TAKE HOME wages have been reduced by by 60% which renders you impossible to do anything but rent a bedspace on craigslist? How is that not immobilizing? I have to steal out of the refrigerator at work to eat? How is that not bed ridden? The only thing you can afford is a bed?

So why pursue a wife? She not accustomed to the ways of the u.s. therefore doesn't believe in cheating and making your way thru the system by sleazing ur way thru courts. Very traditional and very family oriented. I'm a red white and blue gun toting American... So to speak. But il never ever maintain a wife who's mother worked as a clerk in the courthouse. That divorce/child support cost me a 5 bedroom house and set me back for 25 years. Never again.

This woman here is a good one. Been skyping for over a year and I found her from the company I work for she works on a off-shore team in the Philippines.

Doesn't believe in the way of the typical America where our divorce rate is 50% +

Thanks all for ur advice. If I want to move forward, its the lottery or I have to lose my legs in a shark attack.

Maybe I can have my exwife come and collect them... It's the only two things she forgot to take with her.

Why is California your excuse, I live in Brentwood, TN (Home of the Country Music Stars), the cost of living in Brentwood is equal to the cost of living in San Jose, and I was still able to get my affairs in order. You need to take a step back, get your obligations taken care of, and then go about your business, stop making excuses for yourself, It doesn't matter what agreements you or she had, the fact of the matter is you did not pay, you chose not to pay, even when you got back on your feet, you still chose not to make things right, because you never had a reason to. Now you have a reason to, explain the situation to her, If she truly is the one for you, she will understand and wait. Otherwise you will have found out very early on that it was not meant to be.
