Hi...I am working on filling out our I-130 Petition. On the second page, on part C. (Information about your relative..continued), it says "17. List spouse and all children of your relative." I interpreted that to mean I would put my hubby's name and his kids. On the example I-130 on VJ, the husband that is petitioning for his wife, put HIS name there. Not sure if I'm supposed to put him as spouse or me as spouse. I really thought it meant for me to put my husband's name, not mine.

Which is correct?

If you are the beneficiary and your husband is the petitioner, YOUR NAME goes there.

The form is clear, it is referring to the beneficiary's relatives.

This is the answer:

If you are the beneficiary and your husband is the petitioner, YOUR NAME goes there.

The form is clear, it is referring to the beneficiary's relatives.

Opposite.

The petitioner would list the spouse and children of the relative they are petitioning.

Example. John Smith is petitioning for his wife Anna Smith and she has 3 kids.

He would write.

John Smith, spouse, dob

Jill Smith, child, dob

Joe Schmoe, child, dob

Doug Schmoe, child, dob

Ummmmmm......I think it is going to have to be put to a vote? just kidding...maybe I should put both our names?? I'm petitioner, I put his name, but maybe that is wrong???

:ranting: It's a pain in the patoot because for the life of me, I could not get that dang I-130 to download to where I could type all that stuff in, so I had to write it out by hand. And you can't make one mistake without starting over.

I tried to download Adobe Reader, but it would just start, I would say yes, then it would go away. While I'm at it, anyone have any ideas on how to fix that? Then I could type the forms....

Please do not do that. It is the petitioner's name along with the beneficiary's children names that must be listed.

My luck, of course I did the opposite...I just wish I could get that dang form to be able to be typed on. Any ideas on that?

Now I'll have to recopy the whole thing...grrrrr

But thanks for the info!!! It really doesn't make sense since the kids aren't mine, to put my name there, but then again, government forms...

Turn off all ad blockers. Use Foxit?

The form is multi use. It's used for spouses of USC to spouses and children and legal permanent residents, to siblings or married children with children. So because some of these visa classes allow for derivatives, this is the only way for the USCIS and DOS to know there may be more than one person applying for a visa based off of a single approved petition. (However, the spouse of a USC doesn't allow for derivatives so each person immigrating needs their own petition). They're just covering all their bases with a basic form.
