1) I-1485 filed in July 2007 based on approved I-140 -EB3 category which is NOT yet current and have been renewing he EAD which is current

2) I-130 (F4 category) Priority date May 2002. As per visa bulletin of Dec 2015 Final Action date is March 22,2003 for India

The I-130 was transferred to National Visa center in 2010 and had received letter to establish communication/agent -which I did and responded
that I want to Adjust Status. So they emailed me as under :-
"

Dear Sir/Madam:The NVC received notification of the beneficiary's intent to adjuststatus in the United States. The NVC does not process adjustment ofstatus cases. We will hold the petition at the NVC until we are notifiedby the U.S. Citizenship and Immigration Services ( CIS-formerly known asINS) to return the petition to them."Question :-a) Do we inform(how?) the USCIS to transfer the pending I-485 towards the I-130 ?b) If we do that and some how takes longer to finalize, would we be able to keep renewing the EAD in June 2016 ?c) Is Consular processing in Montreal better option ? or Can we do it in Tijuana ?

You still have a while until your EB-3 is current.

I think it would be best to talk to an immigration attorney to see how you can adjust status based on the approved F4 petition instead. Since you already have one pending, it's a little complicated. You may need to withdraw one to file the other -- an attorney would be able to better advise.

Also, you don't need to inform them to transfer your I-130 because once USCIS receives your AOS and copy of the I130 approval, they will request NVC to send it back to them.

10/14/2016: Submitted DS-260
