So my hubby and I have lived in Canada for 5 years, but with the recent downturn of the economy and the fact that I miss living in the States, he has finally agreed to move back to the US. My only question is, I know they want proof that we plan to relocate and as much as I can have my parents sign an affidavit saying we have guaranteed housing with them if we need it for the first 3 months or so, we don't want to move to my home state. Instead my hubby wants to search for a job in his current job market, so we'll more than likely be looking at moving to Texas. So I'm wondering if having proof that he is applying for jobs down there (although it seems most places want you to have a green card in hand before they offer you a position), plus my parents endorsement of free housing, and a standing job offer for myself will be enough to show proof we are serious about moving?

From what I have read that will not fly in Canada, maybe elsewhere. Go over to the Canada forum, there is a long thread about this.

you are right, he will have to have a work authorization to get a job in hand.what field of work is he looking jobs in ?

The oil and gas industry. He has over 5 years experience here and a quite a few contacts which is nice since he's one of the lucky people in our area who hasn't gotten laid off.

From what I have read that will not fly in Canada, maybe elsewhere. Go over to the Canada forum, there is a long thread about this.

We currently live in Canada and are moving to the States. So I don't think the Canada forum would help us.

Can he get a transfer with his current Employer? Avoid the problem and a lot quicker.

I think it will.

No, he works for a smaller company here although a bigger/international company did offer him a position literally one day after he took his current position. I told him he could probably look into that, but he likes the company he works for, so I think he's going to stay put until we move. However that does seem like the best course of action to take.

okay, lake charles in LA or houston are two good places for oil and gas. but this industry is struck bad.i have several colleagues who were engineers or physicists and made fortunes in this industry but are looking to transition to a different career path. i believe the slump is temporary. it will also depend what kind of work is he wanting to do ?i am not trying to scare you off but this is the current situation.US economy may not be booming but its still steady and strong.You guys will have to start the process of migration before doing this.once applied,he will get a work authorization lets say in 3 months after applying.he can work after that and look for jobs during the waiting period.

He does more hard labour, is used to working 12-16 hours a day, 5-7 days a week, and started out as a swamper on a vacuum truck. Eventually he wants to become an operator, but wants to go to school for it in the US, not here in Canada. Also our economy has tanked, so yeah the US economy may not be booming right now, but it's doing way better than Canada's economy. Our dollar is currently equal to 60 cents USD and is still plummeting as I write this.

Our current plan is to wait 6 months, save up some cash, and then apply for his green card as my hubby. Since we live together as it is, we aren't in a huge hurry to move right now as we figure out the logistics of getting our stuff down there and where we want to actually live. But thanks for the info on what we can expect.

Montreal doesn't care about the beneficiary getting a job. They care about the petitioner and* their domicile.
And income or assets.

Your current income will not count if it will not continue after you move. Yes the petitioner having a job in the USA is very helpful for the domicile issue. Just to note, Montreal is quite strict on domicile so what you could do at another consulate or embassy, most likely will not be enough for the COs at the Montreal consulate. It's really the only painful part of a Canadian beneficiary if you both live in Canada. So if you don't have a joint sponsor or assets to cover the poverty guidelines (as per the I-864P on the USCIS website) then you will need to obtain employment that covers that poverty guideline before the beneficiary would get a visa.
