Hi Everyone,

I hope you can help me, and I appreciate it in advance! I am an American citizen and will be marrying my Italian fiancée in Italy, and then want to come back to the States with him. Can we apply for DCF? Do any of the consulates in Italy do that? Any help would be greatly appreciated! We want to be able to be together in the shortest amount of time possible, as does everyone here! :)

Hi There,

Thank you for that info! If I get married there, would I automatically be a legal resident of Italy, so therefore could apply for DCF?

Also, he has dual citizenship in London. Could we apply for DCF through the British consulate?

No. You would need legal residency anywhere.

You usually need to live in the country for 6 months before being able to do DCF. Look up each countries embassy here in the US. They will give you the guidelines on their websites on how to become a legal resident.

Well, obtaining legal residency in either Italy or England is a completely different (and I'm assuming lengthy) process depending on what type of residency you'd like to go for, whether it be employment or spousal.

It's probably best for you to just send your I-130 petition to the Chicago lockbox and continue with consular processing. If you want to remain with your husband in Italy throughout then you can continue visiting him during the process for 3 month visits or have him visit you as well since he can enter the US using the VWP.

Rome requires that the USC's "principal residence" is in Italy and that they hold a residence permit. I do not know if they have the six-month requirement; this is not mentioned on the page or the checklist linked from that page. Double-check on that. See their page: http://italy.usembassy.gov/dhs/uscis/services/i-130.html

London requires the USC to have UK residency, and they have dropped the minimum length of residence. (I read that it has to do with how difficult residency is to obtain, but that could easily be tongue-in-cheek.) See their page: http://london.usembassy.gov/dhs/uscis/i130filing.html

The process for obtaining residency in any country depends on that country. Check with them.

Thank you so much AwayWeGo, Teeak, and everyone! All of you have been very helpful. I live in New York and he lives in Italy, if that helps at all. But we'd like our permanent residence to be in NYC.

Hi again Everyone, last question - since I am a legal resident of the U.S., and my fiancée and I would get married in Italy, and we would be coming back to New York, wouldn't I get the DCF for him through a U.S. consulate in Italy, since that is where we will end up? I'm a little confused. If anyone can help me out, that would be great!

Unless you plan on moving to Italy first an actually live there fo fo while you can't do DCF. You will have to send it off to the lockbox here. Have you read the guides on what steps it will go through?

He wouldn't be able to come with you straight after the wedding no matter what. With the cr1 you are looking at about 10 months to a year.
