Hi All,

After I received my immigrant visa, I traveled directly, before getting the chance to get rid of my current ties in my country (e..g. Resign from my job). this is because my wife was delivering our baby in the US, and I had to be with her. I stayed in the US for month, then came back to my country and my job. Been now 5 months. the reason I didnt resign and go the US so far, is that my company is a US company, and I am working for one of its branch. So had the hope to relocate to the US within the same company. however, so far this is not successful.

the Question, I am planning to travel to the US for a week or so (so not exceed 180 days). Will I face issues at the US borders? especially if they know that I work for a company outside the US?

Regards,

dod

Probably not right now, but if you don't actually move to the US in the next year or so you may jeopardise your green card.

It isn't meant to be used as a tourist visa, and if CBP believe that is how you're using it then they may refer you to immigration court and ask a judge to revoke your LPR status.

You probably won't face too many problems this time. However, if the CBP believes that you're not living permanently in the U.S. You will inevitably end up in immigration court and your green card can be revoked.

They don't mind you 'wrapping things up' at home. But if they see a prolonged pattern, you'll be told to get a tourist visa instead.

As a green card holder, you will be taxed on your worldwide income. The green card requires you to live in the US. You may not be able to use the Foreign Earned Income Credit. You will need to file a 2015 US tax return with your foreign income as required to maintain your green card.

You are violating the terms of your green card by living and working abroad without a Re-Entry Permit.

You may want to reconsider your current choice.

Thank you for your reply. How can I reconsider, what would you advice me to do? The reason I didnt leave my job in the first place is that I had to travel quickly after i received the visa.. So in all cases I had to come back to get rid of my ties here.

Do you mean I should resign of my current job before Traveling. Will that resolve the conflict?

what if i travel to the US with the intention to apply for r-entry permit, or a permit to work for a US visa abroad?

Thanks again

Returning to the US on a permanent basis is the only thing that will resolve the situation and allow you to keep your green card.

All Replied, Thanks... I am willing and intending to leave permanently in the US. The thing is I am searching for a job first before moving there, as I cant afford staying jobless.. So that is why I am waiting on moving there.. Although will do at some point in the near future.

I presume all faced the same issue.. most immigrant cant afford staying jobless, so they need some time to secure a job or save more money..
