Marrying in Texas, filing in London for K-3?

Hi all.

My fiancé and I plan to wed next year in Texas, before I return to England and we file for a K-3 to get me back over there with him.

A couple we are friends with have suggested he flies back to the UK with me, and we file in the US embassy here, as the processing times are much faster. Is this so? Can anyone vouch for this or does anyone have any suggestions?

the K3 is practically obsolete, since it takes around the same time as the i130, at the NVC stage, the i129f for K3 will be administratively closed and you will go through consular processing if you send t130, the process will take a year or a little more

I don't know if England has Direct Consular Filing

but forget about filing the i129f for K3

since you have already met, why not file for the K1 as the fiancé visa if you want to be there sooner and marry in the US? he can file now the i129f for the K1, it might take 6 months or a little over 6 months for you to come here and marry within 90 days and then start the adjustment of status process

Not sure if the UK does DCF but if they do, there are rules to it, it's not like your husband can just fly over to the UK on a tourist visa so you can do DCF. I think he have to have lived there for at least six months to do DCF and it has to be on like a student visa or work visa and similar, so that he actually live in the UK and not just be there to visit. But double check this in the DCF forum.

If you're planning on marrying next year in Texas, why not do the K-1 visa. Takes about six months, so if you file in January, you could be over there in July.

K-3 is obsolete, so it's either a K-1 or a CR-1, which takes about a year, give or take a few months.

If you aren't planning to get married until March or later, just do the K-1 visa. Then when you come, you can get married and stay in the US. It's shorter than the others, but there is more filings to do, so a little more expensive. But With your plan, there is a lot flying back and forth that can be avoided with the K-1.

I will also add in that another difference between the K-1 and the CR-1 is the right to work for the person being petitioned for in this case your fiance. CR-1 give the spouse the right to work as soon as they get their green card in the mail where as the K-1 doesn't immediately give your fiance the right to work. So something to consider if he/she is desiring to seek and go to work quickly.
