Hi,

I am US Citizen since 1999 and I have tried to bring my sister for a vacation, but she was denied the visa. My sister take care of me when our parents died when I was 7 years old now I am 42 years old. I would like to take care of my sister like she take care of me, but since she got denied for a visitor visa in 2002.

I am hopping if someone can guide me to the best option to bring her and live with me or even just to visit the first time and see my kids that nobody of my family ever met before.

Do I try for a visiter visa again or do I apply for sister I-130 Green card or is there better option visa out there fro her ?

The family green card it look like it going to take my 10 years or more.

Please if you have any better suggestions on which visa to go for just let me know ?

Thanks so much for your understanding and your help.

Sponsoring your sister for permanent residency will take at least 12 years; longer if she is from Mexico or the Philippines.

She can attempt to obtain a B-2 tourist visa again, but would need to show ties to her home country to stand any chance of receiving it.

Thanks so much for the info.

What can she do to show that she has a good ties to her country. She owns her house, but she is not working right now. I don't think she enough money in her bank. She just don't know what us to do to show them her ties.

My other question please. Can she apply for the B-2 Tourist Visa even if I apply for her green card i-130 to come to the US and live with me ?

You think it going to be problem applying for both the B-2 visa and the I-130 for relative Visa ?

Thanks so much

She can apply for a tourist visa, though one of the questions on it asks if an I-130 has ever been filed on her behalf, and she would of course have to answer yes. This will make it more difficult get her to obtain a tourist visa.

Do you think we should try again for a visitor Visa before I do the I-130 petition ?

How long the process for visitor visa normally will take ?

I also just want to thank you for your help.

You will usually receive a decision on a B-2 tourist visa within a few weeks of beginning the process; the longest period is usually waiting for the interview. I would suggest she not get her hopes up, as if she's been denied once then unless much has changed she will probably be denied again.

I honestly don't think it will make much difference either way whether she attempts to get a B-2 before or after you file the I-130 for her; technically it will make it more difficult, but she likely already has an uphill battle.

Can I file for a visitor Visa for her form the US or she needs to do it from her country in Morocco ?

It is crazy for the I-130 if we file because will be very old by than to even travel . She will be almost 65 years old.

I do not know how to find what the wait time for I-130 in Morocco to see who is getting their visas right now and what year the file ?

I talked to my Governor in my city and they said if she try another tourist visa on the day of her interview they can call the US consulate in Morocco and help out so I don't know how much will do for her them calling .

Tanks everyone.

Your sister will schedule the B-2 interview and complete the process herself.

The wait time under the F-4 family preference (sibling of a US citizen) is approximately twelve years for all countries other than Mexico and the Philippines, so for Morocco will mean twelve years.

Do you know a place where can I get my sister and my birth certificate translated please ?

One more question please . The form I have now for the I-130 it expiring in 12/31/15 do you think I have enough time to get it filed in the next couple days before 12/31/15 giving the time with Christmas and the holidays ?

You think will be good idea anyway to file in 2015 and not wait until 2016 ?

Thanks again

the form doesn't expire for you to use, send sooner vs later.

Your governor cannot influence a CO's decision, for about 159 different reasons. Even the president of the US cannot order a CO to give out a B2 visa. Some governor has no legal authority over somebody admitted into the US as a tourist. He or she cannot 'vouch' for your sister's willingness to comply with the terms of a tourist visa. Your sister will have to do the convincing, not some third party, whether a relative or not.
