Hello people

I am currently on F1 OPT expiring in FEB 2016 and have already filed for OPT STEM EXTENSION. My sister just got US citizenship . We are looking for options to file for my green card and i need answer to following.

1) Is it wise to continue working on OPT or EXTENSION opt and wait for 2-3 months before it finishes and then file for AOS based EAD

2) Am i even eligible for AOS ?

3) what happens to my current EAD if i file my AOS EAD .

4) is transition period (waiting time from opt ead to aos ead) fixed for every country .approx 90 days or does it vary ?

5) should i wait to get an H1 B visa first ??

6) can i only work for current employer or ANOTHER field related everified employer (stem opt requirement) when im waiting to get an AOS EAD or i can work for any one.

7) can i file both employee based GREEN CARD AND SIBLINGS based EAD at the same time ??

Any help with these questions would be helpful and would really appreciate that.

Sorry if any of my question seems lame

hi

exactly

she can file for you, but the wait is over 12 years, so when you finish, you must return to your country, once you return, or you can continue your studies or find an employer, you don't qualify for adjustment of status through your sister

you would have to be legally in the country for maybe 13 years, so maybe it is better to go another route, or she can file the i130 for you and you forget about the petition and wait for over 12 years

Thank you for your prompt responses.

I will now push my employer to start the green card process for me because i just checked and the waiting times on it are hardly 2-3 months on EB2 or EB3 category. Just one question in that regard.

Can my employer start green card processing based on F1 OPT EADs or do i need to get H1 B first and then apply for green card through employer?

These are all questions for your company's immigration lawyer.

A lot of it is up to what your Employer wants to do, not what you want to do.
