would a gofundme somehow mess up my fiancee's chances of an AOS?

My fiancee is Canadian and is here in the states for 6 months. He came over just through the fact that Canadians can come into the states without a visa and stay for up to 6 months. At the time he was my boyfriend and we had no plans to get engaged, but now it happened (yay!) and we are getting married soon while he is still in the states, by recommendation of an immigration lawyer. Since the paperwork is expensive and because of a lot of various circumstances such as his deadline for being here, I set up a gofundme just to raise a little bit of money just to cover the paperwork in time. Would having the gofundme up cause any problems for my fiancee in any way while while file for the AOS, green card, and work papers?

I don't think so, but not having enough money to support yourselves will be an issue for I-134 and the I-864, not to mention life in general.

It's generally advised to always work out your financials before you get married. This is especially true when you plan on sponsoring another individual for immigration as a part of that.

First off, congrats on getting engaged :thumbs:

I take it he be returning to Canada in the new year? and then if married file for a K-3?

As others have said before me, during the AOS phase (once married and your K visa is approved) you need to be able to prove you can support yourself and your fiance without being a ward of the state (wellfare), hence the need to file your IRS transcripts/ proof of ongoing employement (or if your self employed, proof of reliable income) as evidence along with proof of any savings you and your fiance have. Renember that untill EAD is approved he cannot work legally in the U.S and as such is entirely dependent on you. This can take a few months to get approved.

From memory you have to be earning about 125% over the poverty line (I could be wrong here - but its around that mark) in order to sponsor without requiring a co-sponsor (parent.etc).

USCIS can and do look at social media/ online for evidence of a relationship and I suspect that they could find a gofundme page however as long as your evidence is strong I doubt it would be an issue, but it may raise questions on why you need a go fund me page in the first place.

I can, I just don't have the funds currently, just to do hit the deadline before his time here runs out in January. The rest of the time I can, it has just been tight due to holidays and other circumstances.

Yah that makes sense. The gofundme is only temporary, just for the paperwork. His time here runs out in the end of January, so I was nervous of not having all the funds by then. I can afford to cover him the rest of the time, it's just the initial $1,700 that I didn't have, due to time off and other circumstances because of the holidays.

OK, I understand that the holidays are amazing at draining bank accounts!

Personally, I wouldn't use a gofundme page incase it came back to bite me in the future but its obv your call - but putting out two other options:

1) Delaying the paperwork till after the holidays (I know that your keen to get it in the mail and done, but it may be worth recouping a little before going down this route - K1 or K3's are expensive!).

2) As you said its a temporary situation, borrow the money from a family member (I know not everyone can do this as times are tough, just floating it out there), as I assume it would be friends and family primarily paying into your gofundme page in the first place?

With the gofundme page, whats your plan if the page gets less than what you were hoping for?

If I was you, i'd prepare the paperwork now whilst he's there, get everything sorted out and use the time to double check everything is 100% right and all boxes are ticked (as you dont want an RFE from rushing the paperwork), relax a little and then actually file for it once you have recoup'd from the holidays. I'm all too familiar with wanting to get everything just sorted to be together with your loved one but just go with the flow.

the hectic and heartbreak of him having to go back to his home country and them being separated for a long amount of time till he gets his visa verses staying in America and adjusting status and them getting to do the process all from their home together. I think I see the tragedy. set up the account! post link! I might donate!

Your descriptions means that the majority of visa families have gone through unspeakable tragedy. From what she said she spent close to 6 months with this person and he is still going to be on the same continent. Some US phone plans even include free calling to Canada!

Let's try not to compare this to someone's house burning down or not being able to pay for cancer treatment, please.

I'm not trying to cause arguments here, I'm sorry if this is a sensitive subject for some people? I didn't think it would be and I figured maybe people have done it before. I know that raising money for paperwork is very different than unspeakable tragedies, but I know people who have done gofundme's for fundraising and other things that were not life and death... It was mostly for family members and friends who wanted to help out and knew our situation.

I assure you I wasn't going to raise money cause I was lazy and didn't feel like paying the amount needed. I'm not raising it so I can go on a vacation lol

yea I think people see the go fund me accounts as only tragic but really it isn't. my friend set up her own go fund me account when she was starting her book publishing and all her friends and family helped her out. the go fund me account FYI to everyone can be used for many different reasons. from my original post I was just hoping you wasn't going to be using it for everything and you responded only because of the holidays. people can use the go fund me account as they wish. a kid set up a go fund me account to ask for help with a Christmas gift he wanted so he wanted his family to help that lived around the world.

go fund me accounts can be used for ANY and EVERYTHING . just because all you see is tragedy stories with go fund me account doesn't mean it has to be the same for everyone.

I've just never heard of using a gofundme account to pay for a personal life decision I made. To each his own.

if you look on the website people set up go fund me accounts for events, travel, wishes and even beauty contests. its an all around type of thing. and there is even a newlywed go fund me tab.
