If RFE'd would I get NOA1?

Ok. Here's the deal.

My petition was received on Dec. 2nd at the lockbox.

Since then, nothing. Nada. Zip.

I believe that there issue may be that I wrote "Dept." and not Department on the check but I have no way of knowing ANYTHING because I never got the NOA1 or anything else.

Does anyone know the process? If there's an issue right off the bat like this, do they just send it back like that with no notice at all or should I have at least gotten the NOA1 and THEN they send it back for correction??

I'm at a loss and just waiting nervously like maybe it hit list or something.

After they cash your check, you will recieve NOA with case number

Be sure if you send anymore documents, you put that case number in the upper right hand corner of each and every page

Today is only the 18

With all the Christmas mail i am not surprised you are waiting

For your information K 1's will now be closely looked at and process will not be as quick as before.

1. Did you track your case?

If so, if it says it was delivered it most likely was.

2. Is your check cashed? If not, then they haven't gotten around to your case as yet unfortunately

3. Did you include something for receiving electronic notifications?

If not, and your money was cashed, then keep your eyes out for the mail because then your physical NOA1 should arrive soon. I think if you haven't gotten a NOA1 by January you can contact USCIS to find out if they have your case.

I wouldn't worry toooo much though, I think your fine. The physical NOA1 takes a while to get. :)

1. Did you track your case?

If so, if it says it was delivered it most likely was.

1. No. They can't track it without the NOA1. I don't have a number. It was delivered but that's all I've gotten was the postal confirmation

2. The check hasn't been cashed. I've literally gotten nothing.

3. I sent the form for electronic notifications

Actually, if I were in your position, I think I'd just call USCIS. I don't think I'd wait until January.

Yes. UPS next day and I had a tracking number and it was signed for on Dec. 2.

I have called. They can't help me. It's not in the system.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I was just told that if they HAD sent it back for any reason, I should have gotten it back in 10 days.

Yes, I told them it had been signed for. Problem is that the call center isn't the lockbox so they can't go looking for it.

The last person I spoke with put me to an upper supervisor but they can't tell if it's been sent back to me or not.

It's been 8 days past that. I'm just getting told that because of holidays, I'm just going to have to be patient. If it goes past 30 days and still nothing I can check back and they'll tell me what to do.

I'm already set to send an entire new petition. It's tempting to just send it but if it's still coming back, I might get screwed.

I'm almost positive that the reason is I wrote Dept. on the check instead of writing it all out.

But I can't know anything without getting some word.

Honestly.. if someone threw out your petition because of that, that's hella shady. I really hope they didn't do that, cause it really isn't that big of a deal.

I don't think they "throw them out". It just would have been rejected and sent back to me snail mail with why and what to do.

I've been checking with my post office and the neighbors. Nothing has come back.

Well, at least it was delivered. There isn't anything you can do but wait.

When they do get to your petition submittal, they will examine that everything seems to be included (but not a real thorough review of each document), remove the payment and cash that (that is what they are the quickest of doing!) and then bust all the documents up, place them into a secret order in a folder and then assign a number, scan it in and place everything into a box.

Then it goes into one of those Indiana Jones warehouses and you wait for months.

So the check being cashed might be your next sign of life !!

Then the NOA1 number follows that. Then the wait begins.

It just hasn't been processed yet. But occassionally things get lost. You can send again and cancel the previous payment if you choose.
