HELLO EVERYONE

My fiance is unemployed , so she can not be my sponsor , her father is going to be my sponsor . he is US citizen as well. i need to know , we only need to send i-864 affidavit of support form only ? or my fiance has to fill i-134 form too.

please respond as soon as possible.

Both the petitioner and the cosponsor complete 134 forms and included as much financial documentation as possible.

the petitioner is always the primary sponsor, unemployed or not, they still need to fill out an affidavit of support. Joint sponsor fills out a separate affidavit of support. Please don't type in caps, it is considered yelling.

so its clear that my fiance has to fill affidavit of support, (i-134) i want to know that father of my fiance has to fill i-864 ? right ? sorry for typing in caps, i was filling out forms in caps so , i forgot to turn caps off while typing my question here. thanks for the reply. it will be nice if more people can contribute to my issue.

Both of them will fill i134 separately.

The same way Words in caps here don't look good, i believe they will look the same in forms too. Just my opinion. Any reason you are filling the form in caps?

If the sponsor cannot meet the financial minimum on his or her own, the first step is to see if another member of the household in the U.S. is willing to contribute income and assets to the mix. A household member is someone who:

• was listed as a dependent or joint filer on the sponsor’s latest tax return, or

• is related to and shares a residence (home) with the sponsor.

The household member agrees to support the immigrant by signing a supplemental Form I-864A. One nice thing about using a household member’s income is that it has to be only enough to make up the shortfall in the main sponsor’s income. However, the potential household joint sponsors should realize that if for any reason the main sponsor doesn’t support the immigrant, the joint sponsors can be made to provide the full support amount. (The form itself supposedly warns the signer with the following legal jargon: “I, the Household Member, … Agree to be jointly and severally liable for payment of any and all obligations owed by the sponsor ….”)

If the petitioner’s income is insufficient to meet poverty guidelines, the applicant should obtain a joint sponsor. The joint sponsor should submit an I-864, an I-864A signed by any member of household (if applicable), evidence of the joint sponsor’s legal status in the States (such as a copy of their naturalization certificate or greencard) and their most recent tax returns with all schedules and W2 forms. Applicants chosen through the Diversity Immigrant Visa Program, who opt to present an affidavit of support from a sponsor in the U.S., should use form I-134.

If you are applying for a K-1 visa, the Affidavit of Support is I-134, since it's a nonimmigrant visa. They cannot take an I-864. The I-134 is not legally binding, so they do not have to accept a "joint sponsor"'s I-134.

If you have already entered on K-1, married, and are applying for Adjustment of Status, then I-864 is needed from the petitioner (your new spouse) and also any joint sponsor.

In this K1 case, your fiance needs to fill out I-134 and her father needs to fill out I-864 as a household Joint sponsor along with supporting evidence. You need to bring these signed original documents to the interview or send it with packet 3 before the interview. It depends on the case.

It's as simple as that.

Why not contact the consulate and ask them directly if they want an I-864 from a co-sponsor for a K-1 visa, or to use the I-134 form? Most consulates ask for the I-134 from petitioner and co-sponsor, but it is not unheard of for a consulate to ask for an I-864 for a co-sponsor for a K-1 in some situations.
