Hi VJ,

We are getting ready to send in our I-751 packet. My wife was arrested last November for fighting and was taken to jail where she was held over night. We got a lawyer and the charges were dismissed without prejudice. She never pled to anything, nothing was deferred, the charges were just flat our dismissed.

We answered yes to the question asking if she has ever been arrested or convicted, and will be providing certified copies of the disposition from the courthouse showing all charges were dismissed. Is there anything else I should include in the packet?

I know this should not be an issue because the charges were dismissed, just want to make sure we are doing things correctly. Thank you!!

I actually had an arrest as well and plead guilty and had to include deposition papers for the i751. From what I have heard, from the lawyer, is that you definitely have to led them know Incase of an arrest and Incase of conviction, however in your wife's case there is no conviction just an arrest and was never found guilty of any harm doing so I think she will be just fine. But do make sure to take sufficient evidence like the ones your lawyer used in court to win your wife's case.

Very brief, can be misleading, but anyone can have access to court records, you did the right thing by reporting this up front.

Any auto insurance has access to anyones driving record and so does the USCIS, may even ask you about speeding or even parking tickets even though they tell you, you don't have to if the fine is below a certain point. All depends on what interviewer you get stuck with.
