Affidavit of Marriageability (Single Statement)

Hello everyone , I have my divorce decree and has been certified by the department of state. Can you tell me do I need it translated before to taking to Chinese Embassy here in the states( New York) to get my Affidavit of Marriageability (Single Statement) from them to take to China with me? Any pros or cons as to getting it done here at Chinese Embassy or in China at our US consulate?

I will be applying for the CR-1 visa after marriage.

Chinese consulates do not require translations of those statements. When you and your fiancée go to the bureau to register your marriage, the bureau will send you to a translator of their choosing to translate your statement and the certification document attached to your statement.

If your short on time or have tight schedule when you make the trip to get married, then get this done stateside.

Ok so I can take this divorce decree to the Embassy in New York to get Affidavit of Marriageability to take to China with me to show I'm single and able to get married ? And the paper they give me will be okay to use to marry in China? I know after marriage we have to have things translated for CR-1 process

To get the semantics out of the way first, the Embassy is in Washington DC; the Chinese diplomatic mission in New York is a Consulate.

Based on your posts, you've obtained the necessary certifications for your divorce decree.

You will now need to do the following:

• Write up your own statement that contains the following information:
  • Your name
  • Your country of birth
  • Your citizenship
  • Your passport number
  • Your current address
  • Your employer and employer address
  • The name of your former spouse and the dates you were married and divorced
  • A line that says you have been single since the date of divorce
  • An attestation that all of the information is true and correct
• You will need to have your own statement notarized.
• Once the statement is notarized, you will need to follow the process for your state to have it properly certified
• Once you have that certification from the state, you take that along with your divorce decree to the Consulate.
• You will then need to fill out the application for authentication (I don't know if one or two applications will be required, ask the Consulate). The Consulate may also require photocopies along with the original documents (confirm with them, or bring anyway so you will have it if they need it)
• Once the Consulate has the documents, application, and fee, they will affix the authentication seal to your documents.
• Once the seal is affixed, the documents will be ready for use in China.

Yes the consulate in New York...Thank you...After reading some other post it might be just as good for me too take my divorce paper work to American consulate in China to have affidavit done there . Thanks again for responses...
