We still are waiting for for update form Nebraska Service Center. They received our docs. Dec.14th but no updates since then.

My wife and were talking about her applying for a tourist visa (B2 ?) at the embassy in Lima while we are waiting for the CR-1 to process. Can anyone tell me if this is a good idea or bad idea and why?

Hi KH, oh this is the age old question that's been asked so many times on VJ. I was hoping someone else would weigh in on this one cause I don't have a good answer. As far as USCIS goes you can do it. Its the US Border guards that we don't have a good answer about. You don't know what the border control person you have to deal with is going to ask you.

1. If the person she talk to ends up cornering her into telling the guard that she is coming to see you, her husband. The first thing the guard is going to ask is probably about what strong ties she has back home and / or why they should believe she will not just stay in the US.

They might ask if she has a return ticket etc. What is the purpose of her visit etc.

In the past people used to file the K-3 along with the I-130 which allows for her to wait with you while waiting for the CR1, but on VJ they always say the timing makes it unworkable. I mean if the K3 gets approved by the same time as your I-130 what good was the K3.

Being at Nebraska, you may be approved in 2 months, and then she will have to go back to Lima to do the interview. So I don't know is the risk worth it for you, I mean about the possibility that she might be forced to go back to Lima immediately after she arrives at the US port of entry?

This forum is so quiet :rofl: compared to other forums. I read the forum of Nov filers, quite a number of filers have been approved. So seems December filers turn are just around the corner.

Are there anyone filing at Nebraska? Seems they are working on Nov filing now, you guys will expect approval by any time in Apr. Cheers !

Yes I'm a Nebraska filer and I'm trying to wait patently. I'm already 104 day so far be the days feel like there getting longer and longer lol. All hope it doesn't be to much farther down the road.

We are on the same boat. Surprisingly Nebraska is moving quite fast from 2016. Do believe you will be approved in Apr.

My husband file I 130 for me and my daughter on December 24 2015 and we received noa1 December 31 2015 and our priorty date is December 29 2016 and it is been process at the nsc . I got approved on March 8 2016 and my case was forwarded to Dos but my daughter case haven't been approved yet. Can anyone tell why my daughter case wasn't approved along with mine?

Hi Restrion, oh I'm sorry to hear this, that's terrible! How old is your daughter? I ask cause there is an age limit but I think its around 18 or 21. Also is your husband a green card holder or a US citizen? Possibly, did they request a DNA test on your daughter, just trying to think of possibilities.

When you say your case was forwarded to DOS, do you mean to NVC? Has the NVC or the embassy told you anything? If you can't get them to answer you maybe your husband needs to talk to his congressman or senator.

I suggest you ask for some advice outside of this thread cause there are people who may be able to give you some sort of idea but they can't see your question here.

My daughter is 6 and my husband is a us citizen. My case was approved in 2 months so we are awaiting for the 5 months processing time for her before taking any decision. They haven't asked for any additional evidence or dna testing.

Ok I guess you wrote the wrong dates in your first post, Dec 2015 to 2016 would have been over a year you are waiting.

You were approved in 2 months, so I guess you both live abroad.

I don't know why they didn't approve your daughter that's very strange.

Yes NVC is part of DOS but going to some other part of DOS would have implied there was some other problem.

Still what does NVC tell you when you or your husband ask why your daughter has not been approved yet?

When you mentioned Priority Date I thought maybe your husband was a green card holder and in that case the Visa is not always immediately available.

You were approved in 2 months, so I guess you both live abroad.

Oops never mind I was obvously sleeping! Dec 2015 was only 3 months ago! :)

Oh sorry now I understand. You were approved by USCIS and got your NOA2. But you didn't have to file a seperate petition for your daughter right? Did you have to file a seperate petition for her? If you didn't have to file a separate petition for her why would she need to get approved?

Once you do the interview you will both get the Visa. Does she have a seperate passport or just listed on your passport?

I am just guessing cause I have no facts about the process for children.
