ADMINISTRATIVE PROCESSING - WAIT TIMES - OUR RIGHTS

Well, I have not been on since I filed Nov '14...stressed, depressed and on the floor, 1 year and counting.

-My husband had his interview Nov 17, 2015

-Put on admin processing (green letter stated if we did not hear from them in 3 weeks to email a specified email address)

-About a week and a half after, consulate called me and did little interview over phone with me & said they'd be in touch

-3 weeks & 2 days passed with nothing so I emailed

-Basic repsonse, still in processing, post will contact beneficiary when a decision has been made (I have been in contact with the Colombo Consulate since before we got married last year and they are very good at responding quickly)

-My attorney emailed Lanka's Monday night, no response on Lanka's Tues morning

So finally my questions...

My understanding is not to bother the Cosulate too much regarding the case. True or...?

What are my legal rights?

At what point, how long should I give them, before I contact my Congresswoman?

What other things can I do to help them along/ who else can I contact, etc?

At what point should I risk my safety to travel, all of my health & just continue the fight from Lanka?

This is like a book ha? Sorry.

Any additional information, comments, questions you want to throw in, I'm waiting to hear you and appreciate you...

What would be the reason for them to put your case on AP? Did they ask for more evidence? I'm just curious.

I'm sorry this had happened to you, I think you should've contacted your congressman the moment your case was gone into AP mode. I wish you get a good news before Christmas.

Did they request additional documents?

If not then not much you can do but wait until they do their review. I think maybe a friendly reminder here and there may be helpful but not much can be done.

This is just a part of the system and it is unfortunate that some may have to deal with more AP than some.

It might not actually be the embassy's fault. If the Sri Lankan government is not responding to requests for records or verification of data in a timely fashion that can cause AP to continue until the U.S. consulate/embassy gets the information they feel they require.

I have no idea how long the wait is! But google the consulate your case is at and find the info about immigrant visas. US consulate in Cuba for example specifies visas would be issued one week after the interview. However the case can go on administrative review for 60-90 days after interview; sometimes it can take up to a year. So really no rights when it comes to immigration.

My uncle's wife had her interview in June, they told her to come back three times because the visa wasn't ready. Finally, the fourth time she came back and they told her the AOS did not meet the income requisites. Long story short, they resubmitted the AOS last month, and now her medical exam is expired. SO it's just a mess.

Good luck with everything, and I'm so sorry you are going through this.

My mom has her interview next month and we are praying for no administrative review.

Date I-130 NOA2 (Approved) : 07/30/15

Received DS-261 / AOS Bill : 09/08/15

Pay AOS Bill : 09/08/15

Send AOS Package and Send IV Package 09/30/15

Submit DS-261 : 09/27/15

Receive IV Bill : 09/25/15

Pay IV Bill : 09/25/15

Case Completed at NVC : 10/28/15

Interview Date: 01/27/16 -Approved-

Visa Pick up Date 02/03/16

POE Miami 02/09/16

Hi!

Just found this post, even though they mention Visas B1/B2. The same security system is applied to all of us. I don't have any issues with whatever they want or need to find out. I do have a big one with the time is taking. its an extremely painful and stressful period for a family.

You can read all about AP in the above forum. There are many couples stuck in the black hole of AP that can last days, weeks, months, or even years. There is a couple in AP now for 17 months. Not trying to scare you, but the VJers in these threads can be very supportive and helpful.

I am under administrative process from 17 November(proof of relationship). who is the reason that you are in the process of administrative?
