If your attorney disagrees regarding c(9) and says c(31) is more quicker then ask him/her to read i-765 instructions and it says on page 7 section M

" If you are the principal beneficiary or qualified child of an approved VAWA self-petition, you are eligible for work authorization. :"

If you use c(31) then they will start processing your EAD after i360 is approved. Keep this instructions link handy just in case.

Desert storm they update the charter each two months.

So you mean it will not happen this month but in January ?

Sabinevalerie having a diagnose of major depression or PTSD doesn't mean your VAWA will be approved, you need to prove bonafide marriage as well, and your affidavit and evaluation must have all detail

can anyone tell me please how long it takes for VAWA to be approved? I am about to apply and I wanna now how long I will gave to wait for decision.

It takes around 5-6 months to get approval but each case is different and times can variate. It also depends if you receive additional evidence request or not.

I need your help. I filed my VAWA concurrently with AOS,, 756, 131 etc but I just realized that I forgot to include the biometrics fee. I sent only $985. What do you think might happen to my application? Thank you all for your help.

USCIS may reject your application for incorrect filing fee but you could just resend the package with a check in correct amount. Keep the files in the order they sorted (they usually re-organize your files using rubber rings) and include the reject notice. Good luck!

Thank you miloy! Do I have to send two checks? Also, should I pay the new filing fee or the old fees since I sent my packet before 12/23?

Also I am paying only the filing fee for 485 and biometrics right?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

Hello Everyone,

My husband hadn't filed any petition for me which makes my presence here a Visa OVERSTAY.. I've exceeded the 180 days of course and been out of status for a few years now (8 years) and it subjects me to a 10 years bar

Lately I submitted my I-360, 765 & 485

Now if I apply for I-131 would that mean I can travel outside the US and be allowed to re-enter without risk or Will I be banned from re-entering?

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)
