Hello destined2beme I sent my package September 31 2016.

It is going to take a while. The last time I checked they were processing march 28 2016. I filed in june ending and I receievd prima facie and EAD but no update since then. We can only keep our fingers crossed and keep praying.

My VAWA packet was received by the USCIS on Oct 26. Prima facie was issued on The 1st week of Nov. My lawyer submitted i360, i485, i765 altogether.

I moved back to my home country in April 2016 because it is hard for me to stay in the Is. My lawyer said that we can try to atill pursue my application.

Is there anybody who has gone through the same? How did it go? Does it take lesser time to process i-485 and i360 if they were sent together? Not to mention if it will be approved or not.

Praying that my application would be approved.

4/29 - I-129f Sent to TX Lockbox

4/30 - Received as per USPS tracking

5/5 - Received NOA1 thru txt and email

5/6 - Alien Registration Number Changed

5/9 - Received NOA1 by mail

5/12 - RFE

5/19 - Submitted docs for RFE

5/21 - RFE Response

6/2 - NOA2, yay!

6/7 - NOA2 hardcopy

6/12 - NVC Received, case number ok

6/13 - In Transit to Consulate

6/17 - "Ready" for interview

6/18 - Medical

7/1 - CFO Seminar

7/18 - Interview APPROVED

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

MCbay If you left the U.S with the advance parole you still can return to the U.S to attend the AOS interview, but if you left without advance parole then you can't have an interview in the U.S anymore because your AOS will be considered abandoned .

If you will attend the interview in your home Country then your attorney must submit to USCIS form I-824 in order to request further action on the approved self-petition and you will have the interview in the Philippines. Your attorney probably knows everything that I mentioned above but please make sure that he withdraws the form I-485 asap and take further action once your VAWA is approved ok.

No I came on a B1/B2 visa. Then got married.

After a long frustrating 5+ months wait for my lawyer to file my case he finally told me my VAWA Packet mailed (Including I-360, 1-485, I-765 and waiver request) on the 11/8/2016 it's almost been 20 days and I haven't received any notice, is this normal? I am really scared :(

My VAWA is based on extreme cruelty so all I could provide was my own declaration along with affidavits from friends who witnessed my hardship.

I didn't obtain a psychological evaluation since I didn't know it was and my lawyer only mentioned it the week we were filing! I didn't have the time or money for it (I am not insured)

1) Has anyone mailed the forms and didn't receive notice (or got it later than 3 weeks)?

2) Will the lack of psychological evaluation ruin my case?

3) When do I expect a work authorization?

I currently don't work & desperately need a stable job to survive and I am very anxious

Hi gramercy,

1. If you take a look at my timeline on my signature you'll see that USCIS will send you your first notice around 3 weeks from your filing date. Just be patient!

2. Lack of psychological eval will not ruin your case but it makes your case a lot stronger. If you didn't submit your psychological eval on your packet you can find a cheap or free consultation near your area. I myself haven't done that but many of our friends here in VJ are suggesting to do so. I also don't have work that's why it's hard for me to get evaluated.

3. Check my timeline also but take note it's always different case to case basis.

My VAWA timeline:


10/04/16 - VAWA Packet sent (Including I-360, 1-485, I-765, I-131, and waiver request) (I sent I-485 concurrently because I have an approved I-130 since my abusive father petitioned me way back 2014)

10/07/16 - USCIS tracking confirmed my packet was delivered to USCIS

10/20/16 - I received Notices of Action advising they received my packet on 10/07/16 and waived my fees. Notice date was 10/11/16

11/01/16 - I received RFE for I-360 to provide good moral character e.g police clearance. RFE date was 11/24/16

11/02/16 - I received notice for biometrics appointment for I-485. Notice date was 11/28/16. The appointment date is 11/15/16 3PM.

11/11/16 - I received approval notice for I765 w/ AP. Notice date was 11/08/16

11/15/16 - Biometrics done. (I arrived at 2:45PM and finished at 3PM. It was swift.)

11/18/16 - I received my new EAD card w/ AP. They sent it 11/17/16

I will look for low cost or free psychological evaluation in NYC!

Your timeline sure gives me a lot of hope, especially that you received your EAD so soon.

I'm not sure if it will be the case for me; my lawyer now says 3-5 months to get my work permit but since I lost my already low paying job.

My abuser is my husband with whom I lived for a short period. He didn't let me obtain status here or let me go home or grant me divorce then completely abandoned me without my own belongings, documents, money or of course out of status as punishment which threw my life off its course completely.

I have no joint documents with him apart from affidavits including one from the friend who introduced us.

I didn't know I had options at the time, I was desperately trying to survive & even the basics of life were not always available to me so I lived like this for a few years until I could finally afford hire a lawyer who told me this is a VAWA case.

I know I have some roadblocks which is why I am so scared but after experiencing how people take advantage and violate rights of those like me without status I couldn't take anymore abuse. I needed to knock on this door and pray for an answer.

I am so glad I came across this forum and thankful for the company I found here; now I feel better to know I am not all alone in this xx

Sandra- I have a question when you have a moment of free time. There was a posting in the Effects forum from a victim who left the US and went overseas to escape the abuse. Her spouse recently died in the US and she posted asking about various things including her options to return. The conversation took a weird twist and users speculated that she would be questioned in her VAWA adjustment interview things like why she would want to live in the US when she has no family/friends/job here. They further speculated that her VAWA would be more scrutinized for fraud due to having no ties to the US- so it shows immigrant intent in filing it and she should expect to be questioned on her motivations for filing and her desires for wanting to obtain status in the US when she is residing outside of the US currently.

To me this sounds absurd. I have never heard of such of thing happening and Im not sure if such questions are allowed to be asked. Do you have any information or comments about this?

USCIS does not ask in the VAWA adjustment interview why the person wants to live in the USA, they know that the VAWA Act requires just 7 things , and there is no provision in the Vawa Act that the person needs to have family/friends or a job here.

They further speculated that her VAWA would be more scrutinized for fraud due to having no ties to the US- so it shows immigrant intent in filing it and she should expect to be questioned on her motivations for filing and her desires for wanting to obtain status in the US when she is residing outside of the US currently? People are getting creative huh? There is no provision in the VAWA act that the person needs to have ties to the U.S, that being said a person won't be scrutinized just because she/he doesn't have ties to the U.S.

I would advise her to file VAWA abroad because she will be questioned at the POE the reason for her visit . She can't lie to them and once she tells the truth they may not allow her to enter. Filing VAWA abroad she has to show a connection between the abuse suffered and her departure from the United States. If she decides to file VAWA/AOS here USCIS will not ask why she didn't file abroad.
