danettepatric if they approved your EAD with a different category than C9 it means that your VAWA was approved, and probably you didn't receive the approval letter.

This is actually really confusing. I filed for I-360, I-485 and I-765 ©(31) concurrently. I received an RFE for I-360 needing my good moral character and also advising that they cannot have prima facie yet. Now I also got biometrics for I-485, and I got the approval notice for I-765 with category ©(9).

I have never asked them to change the category yet but that is what I got.

My VAWA timeline:


10/04/16 - VAWA Packet sent (Including I-360, 1-485, I-765, I-131, and waiver request) (I sent I-485 concurrently because I have an approved I-130 since my abusive father petitioned me way back 2014)

10/07/16 - USCIS tracking confirmed my packet was delivered to USCIS

10/20/16 - I received Notices of Action advising they received my packet on 10/07/16 and waived my fees. Notice date was 10/11/16

11/01/16 - I received RFE for I-360 to provide good moral character e.g police clearance. RFE date was 11/24/16

11/02/16 - I received notice for biometrics appointment for I-485. Notice date was 11/28/16. The appointment date is 11/15/16 3PM.

11/11/16 - I received approval notice for I765 w/ AP. Notice date was 11/08/16

11/15/16 - Biometrics done. (I arrived at 2:45PM and finished at 3PM. It was swift.)

11/18/16 - I received my new EAD card w/ AP. They sent it 11/17/16

Hi everyone. I'm new here and I've been following this great thread. I've learned so much on here and I would like to thank everyone for all their advice and inputs especially Sandra!

I was told i qualify for Vawa but I'm not sure. I just have a few questions but first let me give a little summary.

I live in N.Y. I Came on a b2 visa in 2000.I have been married to a USC for 3 yrs now. We were highschool sweethearts and friends for over 10 years. My husband was the sweetest person but behind closed doors he was a totally different man when he got upset. He would get physical everytime he drank or had a hard day at work. Verbally,mentally and physically.I threatened to call the cops one time, took pics when he punched me in the face and he found them and broke the phone. I never tried calling the police on him again because he has friends in different precints where we live (they would often come hang out together at our home) and i was also afraid of him going to jail I also didn't want to jeopardize his job. and i was really afraid of the repercussions of getting him arrested and having the police ask about my immigration status.I was just too afraid.

He would often choke me, slap me around, pin me to the wall, take my keys and cellphone to work with him, threaten to have me deported and take my daughter away. I took pics (not many) when i could and sent them to my email and then deleted them just in case. He's thrown meals that I've cooked at me when it wasn't what he felt like eating. He would take my pay when i came home from wrk and leave me with $50 for transportation and food for the week. My only 2 witnesses are his brother and mother and they don't want to get involved so they won't write an affidavit.

I finally moved out after he punched me in my belly when i was 4 months pregnant and i haven't looked back. I have an affidavit from our mutual friend who took me to the E.R that day.I want to know if i have a case. And if i do...

Can i file i360 i485 i765 i912 g325a concurrently?

I have declaration,photos, Marriage certificate, bank statements, lease, phone bill, ConEd bill, passport pics, tax returns.

I'm waiting on police and state clearance, friends and family affidavits of good faith marriage and good moral character.

How can i show that my husband is a USC? I've tried getting a copy of his birth certificate or vital records but NY doesn't allow spouses to obtain copies.

Is it ok if I don't have a police report?

We filed joint taxes last year and my daughter from a previous relationship is on there but not our baby. She doesn't have his last name.he's never even seen her.

Will that be an issue on our taxes?

Do i have to send in a copy of my daughters' birth certificates?

Should i mention that I have an ITIN in my cover letter even though it's already on the tax forms? Should i send a copy of the approval ITIN letter?

My husband never placed me on his insurance.Only my daughter. He would agree to do it and then get upset and change his mind. He would said he rather see me pay out of pocket or suffer than put me on there. Yes i know it sounds mean! Will it be an issue that I dont have any proof of insurance?

What documents or copies do i need to include with i765 besides 2 passport photos?

When can i do the medical? Is it best to wait after vawa approval?

Do i need a Psychological evaluation? I don't have funds for it.

Thanks so much in advance. I appreciate all the support here. I have no one to talk to and this is the only place I can get advice. I've called a few local places for Vawa advice and haven't gotten anything. Sorry it's so long.

Case moved Oct 2015

Got medical notice that I should wait to hear what to do with my medical

There was no action on my case after that for month so in May I did a infopass appt there I learnt that my case was in their office since late April.

There was still nothing from USCIS until September they request I send in my medical.

Nov 21 2016 status online change to new card production order

1. I haven't replied to their RFE yet because I have no funds at the moment and my friends are all busy.
2. But since I got my new EAD card, it's going to be a big help for me to comply with all the procedures.

Destinedtobe. You can file VAWA without a police report but you should attend 5/7 therapy sessions and have a psychological evaluation done.Find some place in NYC where you can have a psychological evaluation done without costs.

You can file I-485 along with your VAWA case, but keep in mind in case that if your VAWA is denied you will be removed from the U.S because of the pending I-485, or you can submit after VAWA approval, but if you need to work asap then file right away the I-485.

Hello..I have a question and I am hoping Sandra or someone else can answer it here.

I applied for VAWA, i765 and i485 on September, I already received prima facie and got biometrics done for me and my daughter because she is incluided in my vawa case and ajustment of status. We also applied for a i765 for her, she is just 5 yo but I want she gets the SS number.

2 days ago I received an email that says My i765 was approved but I did not receive anything about my daughter's i765 yet. Is it that normal? Because we have been receiving all notifications at the same time but now.

I am worried!

Mariposa your daughter doesn't work and doesn't pay tax,that being said she doesn't need a work permit and USCIS will not issue the work permit, she is 5 years old.

She doesn't need a social security number now to study or to go to school,to see a doctor,to have a passport etc.

Thanks Sandra! What you say has to much sense. But I do not understand why the organization that helped me with the applications said she can have a work permit and that after that she will have a SS?.

So I should not wait for that no more.

I am thinking about to ask for a i131 to go back home. Do I have to wait for my vawa to be approved. When is the best time to use that? I entered with k1 visa do you think it will be ok for me to go back and reenter without problems?
