Hi everyone,

I just wanted to share my journey with you since reading here helped me a lot during the wait. I finally have my Greencard :)

I filed for VAWA after mental and physical abuse from my spouse after petition approval, but before I received my interview date so my attorney was able to have the I-485 put on hold until my vawa petition was approved.

Together with the vawa petition I submitted my own affidavit (around 2.5/3 pages) and 2 affidavits of friends who knew about the abuse (one was about 1 page, the other 1.5 pages), certificate of good conduct, and photos of the physical abuse along with an evaluation of my psychologist (about 1.5 pages). When my attorney received the prima facie it stated that we are welcome to submit more evidence which we did: another affidavit of a friend, police reports and an order of protection that was issued since initial submission because my ex kept threatening me.

About 5 months later my petition was approved. It took a while until my case was forwarded to the field office but after 5 more months my online status changed to "Card is being produced". I was approved without interview.

Side note: I applied for extension of my EAD throughout the wait and after waiting for over 120 days and some SRs I got help from the Congressperson of my district who inquired about my case. They inquired about the status of I-765 and I-485 at the same time and shortly after both were moving quickly.

I found that against the main opinion I read here it doesn't matter the lenghts of affidavits and evaluations but that they are written honest and make sense. The IO needs to understand what happened for making a decision. I was seeing my psychologist for a couple of months before he wrote the short but very good evaluation.

I hope my experience helps those who are waiting.

I wanna say thank you to Sandranj and all her advices to me and everyone else. Thank you sooo much you are awesome.

I only have one question I file my vawa petition on September 3 2015 and the only update was update off the name and nothing else. Now when I when on the USCIS website it says that they are opening cases from march 2016. What should I do do I have to be worried or what should I do is there anything wrong with my case does anyone else has the same issue.

MimoMinkov i think you should schedule an infopass appointment to request update about your case. One member shared her post earlier saying that she filed in March 2016 and got approved September. Your case seems to take over the processing time. I filed mine this May and still waiting too. I'm going to an infopass in 2 weeks

Hi Sandra,

Thank you for answering the last question I asked earlier.

I filed for my VAWA petition in 2nd week of April 2016, received my prima facie shortly after. Up until now, the case status online shows up as 'Fees were waived' and I haven't received approval notice. Its been 7 months now waiting for the decision on the case. When I look at other i-360 (not sure if all of them were VAWA) cases filed on the same date through search feature in USCIS mobile phone app, they also show the same status 'Fees were waived'. Is there a processing delay at USCIS for VAWA petitions? Is it normal to take it this long to be processed? How long does it take for a petition to be adjudicated once the file becomes current?

Everyone else - has anyone else filed VAWA in second week of April 2016 or later and gotten approval?

Hello everyone,

I filed on march 4th and I am still waiting. I did read here that 2 or 3 people filed after me and the got approved already. I never even received a RFE. I am so depressed about this but I am still holding on because I have no other choice. I contacted my congressman in September and they told us to check back in 30 days. and 30 days later when we checked again they said the same thing. and it they added that they will start looking at cases of march 2016. it very confusing. especially when I know that some applied more than 20 days after me and they got approved 2 months ago. I am so depressed.

My attorney says that election influenced a lot USCIS. USCIS was busy with passports and etc. My case was approved in July, since then I didnt hear anything from USCIS. its been 5 months. And still waiting for my work permit though. I check online every day, but nothing((

Congratulations on getting your GC! I can only imagine the relief you are feeling now. The future is wide open so keep your focus there and try to leave the past where it is- behind you..

Anyway, I dont want to be petty, but the length of the evaluation can matter and it does matter for those filing under extreme cruelty. Since you filed with physical abuse an evaluation isnt necessary, it doesnt do much to support it. Things like police reports and photos do matter to support a claim of physical abuse. For extreme cruelty an evaluation is one of the key pieces of evidences along with your own statement- so great care needs to be given to the quality of the documents. That is why it is the main opinion promoted here.

But again I am very glad that the packet you had met their standards and you were approved with not too much of a hassle. 10 months is not that bad and no interview!!! Way to go!!! Very very few get no interview. You were very lucky to not get one. I know the interview is one of the most stressful parts of the process- just the unknown of what are they going to ask can make you nuts... congratulations again! dont forget you can apply for citizenship in 3 years.

Hi Sandra!

It's me again! I just checked my I-765 status online and it says On November 8, 2016, we approved your Form I-765, Application for Employment Authorization , Receipt Number EAC17XXXXXXXX. We will mail your approval notice. Please follow the instructions in the notice. And on case history it says we ordered your new card.

I am just wondering if I still need to submit a new I-765 with category ©(9) as the previous one is already approved? Does this mean I will receive my EAD card?

Is it possible to receive EAD card while I-360 and I-485 is both pending?

My VAWA timeline:


10/04/16 - VAWA Packet sent (Including I-360, 1-485, I-765, I-131, and waiver request) (I sent I-485 concurrently because I have an approved I-130 since my abusive father petitioned me way back 2014)

10/07/16 - USCIS tracking confirmed my packet was delivered to USCIS

10/20/16 - I received Notices of Action advising they received my packet on 10/07/16 and waived my fees. Notice date was 10/11/16

11/01/16 - I received RFE for I-360 to provide good moral character e.g police clearance. RFE date was 11/24/16

11/02/16 - I received notice for biometrics appointment for I-485. Notice date was 11/28/16. The appointment date is 11/15/16 3PM.

11/11/16 - I received approval notice for I765 w/ AP. Notice date was 11/08/16

11/15/16 - Biometrics done. (I arrived at 2:45PM and finished at 3PM. It was swift.)

11/18/16 - I received my new EAD card w/ AP. They sent it 11/17/16
