danette patrick you must write down a letter explaining that the abuser is your father and not your spouse because of this you cannot provide proof of bonafide marriage .

Did you submit a copy of your father U.S passport or a copy of the certificate of naturalization? if you didn't submit yet then you should submit along with the letter explaining he is your father.If you couldn't get a copy of his U.S passport or of the certificate of naturalization you should explain to them why you could not submit and ask them to search regarding his status.

If you want to work then file a new I-765 and put category C 9, and submit a copy of the I-797 regarding form I-485, plus 2 passport pictures, and copy of your passport as well.If you can't afford to pay the USCIS fees then you have to file form I-912,mentioning that you don't have any assets or savings.File form G1145 as well.

Thanks for your response. I will make a letter then submit that letter together with my good moral character. I dont have my father's documents such as passport and naturalization but I already included that in my declaration. But for assurance I will also explain that to them.

In regards to the new I-765 is it also going to be sent to Vermont Service Center? Is there going to be no problem because I already included a form I-765 with category C 31 on my first application?

My VAWA timeline:


10/04/16 - VAWA Packet sent (Including I-360, 1-485, I-765, I-131, and waiver request) (I sent I-485 concurrently because I have an approved I-130 since my abusive father petitioned me way back 2014)

10/07/16 - USCIS tracking confirmed my packet was delivered to USCIS

10/20/16 - I received Notices of Action advising they received my packet on 10/07/16 and waived my fees. Notice date was 10/11/16

11/01/16 - I received RFE for I-360 to provide good moral character e.g police clearance. RFE date was 11/24/16

11/02/16 - I received notice for biometrics appointment for I-485. Notice date was 11/28/16. The appointment date is 11/15/16 3PM.

11/11/16 - I received approval notice for I765 w/ AP. Notice date was 11/08/16

11/15/16 - Biometrics done. (I arrived at 2:45PM and finished at 3PM. It was swift.)

11/18/16 - I received my new EAD card w/ AP. They sent it 11/17/16

Thanks for your response. I will make a letter then submit that letter together with my good moral character. I dont have my father's documents such as passport and naturalization but I already included that in my declaration. But for assurance I will also explain that to them.

Thanks Sandra; I already did the 1130 1485 interview, my application waa recommended for approval bit we divorced in may....never received my conditional....so reason I was asking how I can put it on hold if I already have done the interview. I think my wife was given an rfe to submit divorce papers; she has 90 days to respond...so if she responds...or the 90 days end, then my 1 485 will automatically be canceled.

danette Patrick yes you have to submit form I-765 to Vermont.You will not have a problem because you submitted a previous one using category C31.Question 11 write down pending I-765 and submit a copy of the previous form I-765. Write down in the cover letter that you submitted your previous form I-765 on xxxx with the wrong category.

strongstaystrong it seems USCIS did not approve your AOS otherwise you would have received your GC a long time ago.

You can send a letter to USCIS(where you submitted your AOS) and ask them to put your I-485 on hold and submit a copy of the I-360 receipt as well.There is no guarantee they will put the petition on hold tho.Make sure if your AOS is still pending, the USCIS website is no reliable.

Hi everyone! I got a good news today. After a long journey, I finally got my green card.

I'm very much happy to share my timeline and my journey towards reaching the American Dream with you guys.

8/25/15 - I applied for my I-360, I-765, I-485. Fees were waived

10/8/15- I had my biometrics appointment here in Buffalo, NY Office.

1/25/16 - I made a follow-up for my I-765.

2/5/16 - VAWA visa got approved

2/10/16 - I-485 was transferred to another office

3/13/16 - I-765 got approved

3/15/16 - I received my EAD (It's my birthday)

3/19/16 - I applied to SSN

4/3/156 - I received my SSN card.

8/31/16 - I got the saddest news ever! My I-485 was denied. I immediately called my lawyer in Seattle, Wa. He said not to worry and just wait for the denial letter.

9/1/16 - My lawyer received the letter for DENIAL. They denied me because they were requesting for further evidence. I didn't response to their request so it's considered as abandoned. My lawyer gathered all the proofs that we did not received any letter from USCIS.

9/2/16 - I went to USCIS Buffalo. Talked to the supervisor and asked a copy of the missing letter. They were able to retrieved the letter that they sent last May 9, 2016. They were requesting for my medical record. ( I have it on my hand). They told me that they cannot do anything about it and they told me to apply for I290B, NOTICE OF APPEAL TO THE COMMISSIONER

9/16/16 - I sent my I-290B form, medical record and all the evidences about the letter that we never received (My lawyer's declaration, print out of USCIS case history)

9/20/16 - They received my application and waived the fee ($630).

9/29/16 - They transferred my case back to USCIS office in Buffalo.

11/4/16 - I got a notification that my I-485 was approved.

11/8/16 - I got my green card on my hand.

@Sandra recently USCIS mailed my husband (now ex husband) see below. They sent an RFE for the i 130 originally filed a year ago with the an i485 that was denied. Now I have filed another i485 after my i360 and i765 was approved. He will obviously not cooperate - but I am wondering if this will delay my i485 in any way. My current i485 so far is processing -I am going for biometrics and they already sent it to " A New Office Has Jurisdiction".

Polílla NBC will do the background check and see if some document is missing and they will issue an RFE. Usually the case stays in the NBC 60/90 days and then once everything is fine with the case they will ship to the local office for interview,some local offices are taking 7/12 months to set up the interview,but most of the local offices take 60/90days.
