That lawyer is taking 4 thousands dollars for VAWA and she wants to cancel I485 that is in pending and that way I'll lose my EAD. Psychologist has no idea about evaluation, i told her that's has to be 10 pages. She told me she can't write 10 pages because she will need a lot of time for it and she said she wants to talk with my lawyer why i need evaluation. I tried to explain her. Can you please tell me what she needs to write in that evaluation?

Your attorney will screw up your case big time.

Your psychologist is another lunatic, find a professional competente. She has to describe your background, onset of the problems, number of sessions, describe de abuse IN DETAILS mentioning at least month and year, time and describing the abuse,tests performed (BAI,BDI), diagnose,treatment recommended and referral.If your psychologist describes the abuse in 2 pages and the other pages she just put what I mentioned then your evaluation will be horrible. Some psychologists are so stupid they use font 14 to type to show a lot of pages, tell her to use font 10. DO NOT SHOW to your psychologist your own affidavit.

Hi Sandra!

Good day! I just got a Notice of Action stating that the I-360 I submitted did not establish a prima facie case and the boxes that are marked are

1) good moral character - now they instructed me to get criminal record clearance and police clearance on my local area and I'm on it already.

2) that you married the alleged abuser in good faith - now this I don't understand because the abuser is my father and not my spouse. What relevant document should I submit to provide evidence to this?

My VAWA timeline:


10/04/16 - VAWA Packet sent (Including I-360, 1-485, I-765, I-131, and waiver request) (I sent I-485 concurrently because I have an approved I-130 since my abusive father petitioned me way back 2014)

10/07/16 - USCIS tracking confirmed my packet was delivered to USCIS

10/20/16 - I received Notices of Action advising they received my packet on 10/07/16 and waived my fees. Notice date was 10/11/16

11/01/16 - I received RFE for I-360 to provide good moral character e.g police clearance. RFE date was 11/24/16

11/02/16 - I received notice for biometrics appointment for I-485. Notice date was 11/28/16. The appointment date is 11/15/16 3PM.

11/11/16 - I received approval notice for I765 w/ AP. Notice date was 11/08/16

11/15/16 - Biometrics done. (I arrived at 2:45PM and finished at 3PM. It was swift.)

11/18/16 - I received my new EAD card w/ AP. They sent it 11/17/16

Hello, Sandra:

Thank you very much for all your replies to my previous questions.
For the entering into marriage in good faith, will the following be sufficient:

1. Self-petitioner's affidavit in details

2. two friends' affidavit in details

3. Joint deed of the house purchased right after marriage
4. First 3 months joint bank statement after marriage, which had lots of transaction for items for the new home

5 First 3 months of joint bills (Gas, water, sewer)

May have 2 photos only because all photos were in a lost phone.

I'm not Sandranj, but my two cents:

Do not re-marry with pending VAWA. This would cancel the petition. From the instructions for Form I-360: "For self-petitioning spouses, you may remarry after USCIS approves your self-petition without affecting your eligibility to become a lawful permanent resident or have grounds for revocation of the approved self-petition."

So you may only re-marry AFTER your I-360 is approved.

If you get married when your VAWA is pending your VAWA will be canceled, despite last year I saw two cases that the girls got married after VAWA approval but before AOS approval and both cases were sent it back for revocation.

You didn't ask my opinion about getting married but I will give my opinion anyway. I hope you are dating this person at least one year or two because 99% of the abused people got married after a short courtship (3/7 months).I helped two VAWA petitioners that remarried and were abused again (short courtship again).They stopped their VAWA petitions and then filed a new VAWA and both cases were denied after filing VAWA for the second time. I didn't handle their cases but they contacted me asking my help, but I did not help them because I had doubts if the marriages were entered into in good faith.

milloy001 without seeing your case I cannot tell if your proof is enough or not, your own affidavit detailing the courtship plays a huge role in your VAWA case. I saw VAWA cases that the victims had children with the abusers and USCIS asked proof of bonafide marriage and I saw marriages that lasted one week and the VAWA petitions were approved without any commingling finances.

Wow, that's crazy, so despite what the I-360 instructions state, a VAWA filer should NOT re-marry before having the GC in hand because it can still be revoked before then. I learned something new today.

Hello everyone.

I want to ask for you advise about filding a form I131 permission to travel while my vawa and 1485 is pending.

I have almost two years without see my family and with all is happening in my life now I am getting crazy.

Someone here who has expirience please advice me if this is a possibility for me.

I entered to the US with visa K1 and I applied for VAWA last month and got a Prima Facie.

Hello everyone,

Last week Nov. 2 I received an RFE to provide police clearance and criminal history record to which I currently taking care of. Also, I got a mark on the last box. (please see attachment) However, my abuser was my father and not my spouse, how do I clear this up?

My VAWA timeline:

Also, I have received my appointment for biometrics of Adjustment of Status.

I have submitted I-485 AOS together with I-360 and they're both pending. I have a problem with my I-765 I used Category C31. Should I file a new EAD application with category C9 so I can get EAD before VAWA is approved?

Timeline

strongstaystrong they will put your I-485 on hold just if your spouse does not withdraw the AOS. USCIS usually does nott take in consideration a letter asking to put the case on hold,the person has to ask when attending the AOS interview.
