USCIS local offices in NYC take 5/7months to set up an interview, despite I have one case 9 months with the local office in NYC.

Oh wow really? I always thought they send out the notice just a couple of weeks after receipt.

I'll stop checking the USCIS website like a crazy person then, and continue to be patient. It's been almost three years since I filed, I could've been halfway to my road to citizenship...

Thanks Sandra!

Coolbeans make sure the EAD has your name ok.USCIS is messy sometimes. Return the EAD to USCIS because your work permit is still valid, and write down a letter saying your permit will expire just in June and you didn't submit form l-765 to renew thr work permit.

Hi there guys!

Good day! My lawyer applied for my VAWA, EAD and AOS last Aug 25, 2015. I got my biometrics last Oct 8, 2015.

I went to USCIS office here in Buffalo, NY to make a follow for my EAD last Dec 12 2015, until now I haven't received any update.

I'm worried about EAD, it's taking so long. My lawyer requested for follow up but no response yet.

What should I do? I appreciate your response. Thank you very much,

Thank you Dodgertown!

When was the interview date? About a month later?

Did you see the case status change online when they sent it out?

Sorry for the delay with response.

Yes, interview was a month ahead, for Oct. 20. And no, online case status never changed. I am 100% sure that yours will also not change. You or your lawyer will just get a letter in the mail. Online status will change after your AOS interview.

Sabinevalerie having a diagnose of major depression or PTSD doesn't mean your VAWA will be approved, you need to prove bonafide marriage as well, and your affidavit and evaluation must have all details about the abuse suffered, of course if the psychologist doesn't give you a diagnosis of major depression and/or post-traumatic disorder it means the professional couldn't find any abuse in your case.A psychological evaluation without describing in DETAILS the abuse has no weight for a VAWA case.

Hi Sandra and hi everybody,

I am waiting for the copy of RFE from NBC since my lawyer abandoned my case for so long now.

Original RFE was sent out 12/10/2015.

I requested copy of RFE on 01/04/2016.

I called USCIS and they said NBC has 30days to send it to me. OMG by that time the deadline would be missed already, my case will be denied.

I called, emailed, texted, left message to my lawyer office, his cellphone, even threaten to file complaint to Bar Association.

But he didn't reply, his office didn't call at all.

I am so sad and disappointed and mad....

Please tell me what I have to do!

If my case is denied, what I have to do next? Do I have to apply for vawa again?

Linh go to the attorney office and do not leave until the attorney gives you the RFE.Go to thE bar association asap to file a complaint against him, they may contact him. If the case is dEnid for failure to answer thr RFE ypu have to file VAWA again.

Hi Linh Luoung,

I read the response time for RFE is minimum of 84 days. How do you know what the deadline is when you never received the actual RFE? I assume the USCIS will give you at least end of February to respond to the RFE. The RFE might be simple. I was very worried and anxious when I initially got a RFE by email. It ended up being asking me to provide state police report when I received the actual mail. I did a search on many I-360s by typing sequential numbers on the USCIS website. About 60% of the I-360s have RFEs. I believe you will be fine. I believe it is normal to be worried and anxious when dealing with I-360 VAWA cases. The abuse from the spouse might also be contributing to the anxiety and worry.
