well every case is going to be different. Theres a search bar on the top of the page. You can enter a variety of keywords or even go to Sandranjs profile and read just her recent postings.

Here is a in-depth 'how to file VAWA' for attnys. Please see page 9

"“Extreme Cruelty” VAWA’s immigration provisions define domestic violence more broadly than most state domestic violence statutes.59 In addition to physical and sexual abuse, VAWA’s definition includes “extreme cruelty,” defined as: being the victim of any act or a threatened act of violence, including any forceful detention, which results or threatens to result in physical or mental injury. Psychological or sexual abuse or exploitation, including rape, molestation incest (if the victim is a minor) or forced prostitution shall be considered acts of violence. Other abusive actions may also be acts of violence under this rule. Acts or threatened acts that, in and ofthemselves, may not initially appear violent may be part of an overall pattern of

violence."
Please read carefully. Other acts may be acts of violence/ part of an overall pattern of violence.
I am not making this up. Many posts constitute of financial abuse and the same answer is given. An act of that type of abuse ALONE is also not enough. You need a pattern. A good VAWA attny can use immigration related use to show a pattern. A bad one would file with that as the only ground.VAWA law is extremely complex. Not all immigration attnys are versed in it... Sadly some that claim to be arent.
Also as stated above you need to show the abuse was in the US and you resided with your spouse. It does not state specifically how long you have to have resided with them but it is very hard to get approved if you did not reside with them or lack proof of it.

I am extremely familiar with this document as I've already submitted my I 360 (did I mention that?). I've been even posting few excerpts from it today.

I still can't find where it says that 'immigration related abuse' has to come in multiple occurrences.

Timeline

Did anyone here go through the situation where in their GC was sponsored by US citizen spouse and later it was withdrawn and resulting in i485 denial and were in the process of filing VAWA. My question is did any one get an NTA(Notice to appear) in immigration court before they submitted VAWA petition or after submitting.

Briefing about my case
I am JP IT Engineer by profession ( JP is my short name orf V ..tough Indian name ) married US citizen in Feb 2015 on tourist visa in Fort worth Tx. Later on my wife abused me and l left the country because of fear my life as she forced me to do crime & I got class C misdemeanor ticket . She along with her parents witnessed against me & threatened me to kill me.
In March 2016, my wife annulled the marriage so that I should not claim VAWA. I have hired criminal & family attorneys to handle my DV case & Annulment case.
Now I am planning to come USA in September as I have B1/B2 Visa for 10 Yrs.
Attached are latest status of my below AoS
  1. I-130 : withdrawn
  2. I-131 : Revoked the Approved I-131, and USCIS asked my wife to submit documents.
  3. I-485 : Denied
  4. I-785 : Revoked the Approved EAD and USCIS asked my wife to submit the documents
My wife might have submitted some documents , Like Marriage annulment ( which i am trying to Cancel & I am coming to appear in Trial of the same)
Q1) Anybody from TEXAS , Can pls help me to Find
  1. Shelter: where I can stay in cheapest way like community center or anywhere (As attorneys are taking lot of money :crying: ) & I have no place to live.
  2. Psychologist : pls suggest good psychologist having good track record and how can i get medicaid in Texas to pay them.
  3. Best VAWA Attorney : I want to hire for my interview in case I found someone very genuine.
Q2) Should I file VAWA from Texas (e.g. Dallas/Fortworth area, or Houston) or Should I File from California or Minnesota or any other states which gives maximum benefit to the VAWA immigrants once Prima facie is received. Guys Pls Suggest.

Hi i don't know if you can come back to US with your B1/B2 Visa. You probably overstayed as you were in the process of AOS. Your wife cancelled the application with USCIS so its in the system. Secondly i don't think you can do anything about annulment of marriage. Why will you like come to US and stay at a shelter? As Sandra stated you accepted the charges of misdemeanor on your own will and by force. No one can stop you from filing VAWA but you have a long shot. You can file VAWA from India itself. I dont think CBP will allow you if you had overstayed in the past. Which it looks like Best of luck.

1. I have not accepted the charges. the case is with court & I have not pleaded guilty for which i have to appear in the court, which I am doing. (Pls read my last posts on page 42..43 )

2. I have not overstayed. My wife applied for AoS before expiry of my 6 months of legal stay hence we lived together.

3. I can come to USA for appearance in court which is my right to prove myself not guilty & cancellation of annulment which my wife did my FRAUD.

Yes I am not coming to live in SHELTER, Just knowing the facts/Risks/Options..because I know it will be very difficult.

Hi Everyone!

I filed for Vawa on March 22, 2016 so it will be 5 months in a few days. I noticed that the processing times on the USCIS website recently changed from a bit of a backlog to 5 months processing time. I did get the initial receipt and the prima facie but no news after this.

Question: Has anyone who filed around this time received any new about their case yet?

Hi Caveman,

Myself like many others if you check their timeline, it wasn't approved before 6mths... Mine was exactly on the 6mths mark so I would suggest you work with that just so you don't start getting too anxious.

Do you realize there is no such thing as VAWA interview? VAWA itself is adjudicated based on the documents you send. If VAWA is approved, you'll have an AOS interview, but it's not about your VAWA case.
