Justiceseeker it's not considerate public charge to receive unemployment.

Being unemployed is not a reason to to deny Citizenshipm

Sandra,

Thanks for your help. But i read on USCIS site this statement

"Public charge has been part of U.S. immigration law for more than 100 years as a ground of inadmissibility and deportation. An individual who is likely at any time to become a public charge is inadmissible to the United States and ineligible to become a legal permanent resident. "

"Under Section 212(a)(4) of the Immigration and Nationality Act (INA), an individual seeking admission to the United States or seeking to adjust status to permanent resident (obtaining a green card) is inadmissible if the individual "at the time of application for admission or adjustment of status, is likely at any time to become a public charge." If an individual is inadmissible, admission to the United States or adjustment of status will not be granted."

And unemployment is public benefit so will this affect me negatively when i apply for citizenship? How you understand the above statements?

Unemployment is not a means-tested public benefit.

Read thIs article bellow please,it explains what publicly funded benefits may be considered for public charge purposes.

Justiceseeker.

As mentioned by Sandra, unemployment benefits are not considered public charge. In the excerpts you posted, citizenship application was not mentioned; only permanent resident application or admission to the United States. Don’t you plan to get a job by March 2017 when you will apply for citizenship? March 2017 is 8 months away.

Hey VJ members....just wanna give a big shout out to Sandraj and all the members that render their thoughts and much needed help. I have a friend who got married In his home country to a US Citizen 10 years ago. Him and his wife had a great relationship given the distance between them. However, 3 years after being married he got another woman pregnant, and It put a damp In their marriage. They still remained married and worked on their relationship.

On numerous occasions she would ask him to send her money through Western Union to support her.

She would take trips to see him and they'd spend time together.

After a while she stopped calling. He was unable to reach her no matter what he did. She totally distanced herself from him. Is there any possibility of him self-petitioning from his country. I need your Input on this one.

Thank you.

There is no self-petition for him to come to US. He needs the USC spouse to petition for him.

Since you said the USC stopped calling and totally uncontactable, there is a high chance she could have filed for divorce in US already.

Your friend could try to apply for tourist visa though.

EAD/AP card

Hello VJ members my Vawa app was approved in Jan and file transfered to the NBC or local office in Feb, I am still waiting for my I-485 interview in Dallas. I need to renew my EAD but would like to apply for advance parole travel document at the same time. Do I need to file 2 separate applicaitons and pay each fee and does a Vawa applicant pay for the EAD renewal? any advice or help will be appreciated.

thanks

Sarah

Hi Coolbeans. Like you I'm still waiting for my I-485 interview after my file was transferred in May. I just submitted an application for an EAD renewal and I included the $380 fee. Despite having an adjustment of status application pending, my EAD was issued under an approved VAWA application, thus it has to be renewed under the same category. I included a copy of filed I-485 with my work permit renewal application so the adjudicators can decide to refund the fees.

Mother of 3 your friend cannot submit a self petition for himself, just victims of domestic violence can submit a self petition if the abuse happened in the USA

or the abuser is an employee of the U.S. government abroad, or a member of the uniformed services abroad.
