Zndk if your false claim of Citizenship was after 1996 ypu will have your AOS denied again. THERE IS NO WAIVER AVAILABLE. Your Vawa might be approved but for sure they will deny your AOS.

You are not the only one, I saw at least 5 cases of AOS denied because of false claim of Citizenship and all of them were deported. I am amazed that they didn't issue you the NOTICE TO APPEAR in Court in 2001.

Thank you all for your responses. They didn't issue a NTA and my lawyer checked. I worked so I could have money to leave a severely abusive relationship. I will need a miracle.

hi friends,

My combo card (work permit + advance parole) is going to expired in September and my I485 still pending.

I am going to renew it this month.

My questions are:

1. is the fee waived? If not, how much is it?

2. do i have to file both form I765 for work permit and form i131 for advance parole, Or just file i765? Of course i want to have the combo card again.

3. On form I765:What should I answer question 11 and question 15, and 16

Question 11 Have you ever before applied for employment authorization from USCIS?

Yes.

Which USCIS office?

Vermont Service Center OR National Benefit Center???????

Question 15. Current Immigration Status?

Approved I360, pending I485

Question 16: Eligibiliy Category : C 31 vawa

Dear VJ,

I got a text message scheduling me for I-485 interview next month (July 2016) based on the I-130 that I filed in July 2015. It is approximately 1 year from filing date to interview date.

I filed I-360 in December 2015.

I wrote to USCIS that I wanted my I-485 to be in pending status pending the determination of my VAWA case or for the I-485 to be transferred to my I-360. I made the requests in February and May 2016 with USPS Express mails and I have signature delivery confirmations. I did not receive any response from USCIS about the requests.

I did not receive a response from USCIS that my I-485 will be in pending status or has been transferred to my VAWA I-360.

I have read about different outcomes of people that filed VAWA and attended the I-485 interviews filed with I-130. The Immigration Officer may suspend the I-485, deny the I-485 or approve the I-485.

I already contacted USCIS by phone and they tell me they cannot discuss the VAWA with me by phone that I need to contact Vermont VAWA unit in writing.

I do not plan to attend the I-485 (I-130) interview with my wife. Should I file an I-485 with my existing I-360? Or should I wait till after the interview? Thank you.

tell them your story and your vawa receipt notice

either they will :

1- approve your 485 less propable

2- suspend your 485 till your vawa is adjudicated

3- deny your 485 which is very low probability , in this case file another 485 or wait till your vawa is adjudicated and file another 485

but you have nothing to lose because if you did no appear in your interview even alone , your 485 based on 130 will be denied

ZNKID Falsely claiming U.S. Citizenship bar applies to Cancellation of Removal as well .The law states just in case of "extremely limited exception" the relief from removal may be applied .

Proving hardship will not be enough. Living in the USA many years and having a child is not enough either. I don't think you qualify for the exception, it must be something "exceptional" such as you have an incurable disease that cannot be treated in your home Country and if you abandon the treatment in the USA you will die, or your child lay in a coma and transferring her to your home Country will lead to her death, or you have proof that you will be subjected to torture or death in your home Country, as said before it must be something "EXCEPTIONAL"

Finally sent my GC package on 5/26. They've received it on 31st and waived the fees on the 7th. Let the waiting game begin now. Once again Sandra thanks for everything!

Hello everyone,

I am sooo happy because yesterday I have received my GC in mail. I am full of tears and joy at the same time! Finally, my journey has come to a happy end.

My interview was on June 1st, they told me to wait, and next day I got text notifications that my application was approved and they ordered my new card. And yesterday it came.

I want to say thank you for all your help and support. Especially for Sandra! You are an incredible person who helped me a lot who answered million of my questions. God Bless you Sandra!

I wish everyone who is still waiting good luck and sooner approval. I know it is frustrating to wait but there is nothing you can about it, just wait, pray and keep yourself busy.

I will post my timeline here later.

Congrats @Skazzka .... I wanted to update the group. I applied for the renewal of my work authorization card in Dec 2015 & my last update from USCIS was Jan 16,2016.... I lost my job on Feb 26 when my card expired. I call immigration since March 2016 without getting any straight answers, I opened at

least 4 inquiries & even did an infopass on May 9... I was slowing slipping in depression but because I still attend therapy, my therapist did a great job in keeping me sane. I read somewhere about congressman helping someone out with an immigration case so I called the congresswoman in my area & they told me they offer assistant for cases like mine. I did the necessary paper work and email it to my congresswoman office on May 27, 2016, which was the holiday weekend. On June 6, they told me they submitted the inquiry into my case on June 8 USCIS updated my case online to it being transfer to another office. Then yesterday June 13, it updated to my case being approved. My congresswoman office emailed me this morning to say they also got a response from immigration saying my case was approved & my card is in production & I should receive it within 15-30 days.

I couldn't sit around without trying all my options because my lawyer has taken a back seat on my case after I've paid her so much money, that I had to borrow at the time. Guys if you are able to just keep on praying & if you can't just asked someone to pray for you. My I-360 was approved on Feb.1st just waiting on my AOS

My congresswoman office helped me out a lot, I'm going to try seeing if I can get my old job back.
